| Rural areas,as an important link,are an important component of China’s construction of a socialist modernized country.In the process of our economic,political,and cultural construction,the "three rural issues" are becoming increasingly important.In order to efficiently solve the problems of agriculture,rural areas,and farmers,China has implemented the rural revitalization strategy.However,the high-quality implementation of the rural revitalization strategy,rapid economic development,and social harmony and stability in rural areas all require an increasingly perfect legal system for social security.The legal system of social security is a basic legal system of the country,including four aspects: social insurance system,social assistance system,social welfare system,and social preferential treatment system.After the establishment of the People’s Republic of China,the legal system of urban social security has gradually been updated and improved.However,the construction of the legal system of social security in rural areas in China is seriously disconnected from the actual rural development,which has seriously constrained the development and construction of rural areas in China.Therefore,building a new and improved legal system for rural social security that adapts to rural development is not only a requirement for high-quality implementation of the rural revitalization strategy,but also an inevitable requirement for promoting high-quality economic development in China.This paper mainly focuses on the specific practice of implementing the rural social security legal system in Xing’an Meng of Inner Mongolia Autonomous Region,analyzes the important value and significance of this system in China’s social security system,reveals the complexity of establishing and improving the rural social security legal system that is suitable for China’s economic development and the actual situation in rural areas,and reveals the logic of the system.We also explore a series of problems in the implementation of the rural social security legal system in the rural areas of Xing’an League and the reasons for the problems,and take Xing’an League as an example to summarize the common problems in the implementation of the system in rural areas in China.Through the fieldwork and the review of relevant information,we found that the actual situation of rural areas in China is different and unbalanced,but the following problems generally exist:(1)the legislation of China’s rural social security legal system lags behind the actual situation of China’s rural social development,and cannot play the function of legal regulation;(2)the legislation of China’s rural social security legal system is at a low level,and its role and function are easily affected and restricted by the higher law.(3)China’s rural social security legal system is still based on farmers’ voluntary payment of premiums as the main way to obtain social security,which to a certain extent determines that only some farmers with a certain economic base and the ability to pay premiums can participate in insurance,limiting the scope of insured farmers in China and narrowing the functions of the rural social security legal system;(4)China’s rural social security legal system is mainly based on farmers’ independent contributions,and the shortage is subsidized by special funds.However,at present,the fund source of China’s rural social security legal system in the process of implementation is only the state treasury,and the single source channel leads to a small total amount of rural social security funds and poor liquidity.In view of the above problems,the author uses the method of comparative analysis,compares the rural social security legal system with that of foreign countries,and draws inspiration from their excellent practical experience,so as to summarize and put forward legislative proposals and ideas for the construction of the relevant system to improve the rural social security legal system in China. |
