Research On Collaborative Governance Mechanism For Preventing Online Gambling Crime In H City Based On SFIC Model

Over the past two decades,China has made many useful attempts to curb online gambling crime.However,the governance of online gambling crimes is far more difficult than traditional crimes.At the same time,due to the legal norms do not adapt to the development situation of crimes,weak basic work and inadequate cooperation,cross-border online gambling crimes have not been effectively contained.Many regions of China have working modes of online governance,but no effective and perfect long-term mechanism.From the perspective of online gambling crime prevention,to accurately,effective and long-term prevention of online gambling,it is necessary to strengthen multi-subject communication and cooperation,multi-directional,multi-subject cooperative governance.Online gambling crimes in H city are constantly developing and changing in different periods,presenting different criminal methods.H city established an inter-bureau joint conference system for combating and controlling new crimes of telecom network,and set up a joint prevention and control center for combating online gambling to break down the barriers to cooperation and governance of online gambling.However,there are still some problems,such as excessively concentrated power and resources,relatively scattered anti-gambling information resources,and poor cooperative governance information.Various business systems or mechanisms of cooperative subjects are not unified,and there are "fragmented" systems,poor business coordination,and low overall effectiveness.In view of this,this article takes the collaborative governance mechanism for preventing online gambling crimes in H city as the research object,and draws inspiration from the SFIC collaborative governance model to conduct research.After investigation,it was found that there are problems in H city,such as information asymmetry among management departments,conflicts of interest among management departments that affect work efficiency,lack of standardized system design,lack of collaboration among relevant entities,and insufficient publicity efforts.The study analyzed that power is too centralized,resources are scattered and insufficient,interests have diverse goals,non-governmental entities have weak awareness of governance participation,and there are gaps in joint and collaborative efforts;Insufficient organizational leadership and insufficient execution of joint defense across multiple departments;The design of the joint meeting system is in the initial stage of exploration,and the relevant laws on online gambling crimes need to be constantly revised and improved.The division of powers and responsibilities is not clear,and there is a departmentalism;Insufficient face-to-face communication frequency leads to difficulties in collaboration;Performance evaluation has its own system and lacks a consensus on interdependence;Inconsistent demands for common interests lead to insufficient consensus among multiple stakeholders;The reason why the phased achievements have only decreased and the incidence rate has not been completely eliminated.Study proposed that at the level of the starting conditions,Establish a resource sharing platform and a joint joint prevention,control and assistance mechanism,And joint accountability and performance association evaluation mechanism;At the catalytic leadership level,Strengthening government leadership and impetus,Highlight the determination to regulate online gambling,Clarify the functions and standardize the rights and responsibilities of the subjects,Strengthen the initiative and responsibility of the law enforcement leadership subject;At the system design level,Establish an open participation mechanism,a transparent system operation system and a clear and reasonable code of conduct and other collaborative participation system;At the synergistic process level,Promote the promotion of online gambling prevention,Add face-to-face communication platforms for joint prevention and control,Establish a community awareness of responsibility for online gambling prevention,Set up the phased governance goal and realize the phased governance results.It tries to make further suggestions and supplements to the research on the collaborative governance mechanism of the prevention of Internet gambling.This is not only conducive to improving the current cooperative working mechanism of preventing online gambling in China,but also conducive to the effective use of cooperative governance mode to prevent online gambling crimes in the actual process.
