| As is well known,the greenhouse gases emitted by ships can have adverse effects on the marine environment and human health.Currently,the greenhouse gases emitted by ships account for a significant portion of the total global greenhouse gas emissions.As the total greenhouse gas emissions from ships continue to increase,it will further exacerbate the global greenhouse effect.Therefore,in the context of the increasing demand for maritime transportation and the continuous deterioration of the marine environment,it is very important and urgent to control the greenhouse gas emissions from ships.To control greenhouse gas emissions from ships,it is of great value to establish a legal system aimed at reducing greenhouse gas emissions from ships.The international community has made tremendous efforts to reduce greenhouse gas emissions from ships.At present,the legal system for reducing greenhouse gas emissions from ships is represented by the relevant systems of the United Nations and the International Maritime Organization.The United Nations has led the development of relevant international conventions such as the United Nations Framework Convention on Climate Change,the Kyoto Protocol,and the Paris Agreement to control greenhouse gas emissions.The International Maritime Organization,as an international organization specifically responsible for reducing greenhouse gas emissions from ships,voted in 1991 to adopt a resolution on preventing air pollution from ships and called on the Marine Environment Protection Committee to develop a new annex to the 1973 International Convention for the Prevention of Pollution from Ships on the Prevention of Air Pollution.There have been significant differences in the application of legal principles for reducing greenhouse gas emissions from ships between North and South countries.The majority of developing countries unanimously agree to apply the principle of common but differentiated responsibilities,but developed countries do not agree with this.The international community needs to work together to reduce greenhouse gas emissions from ships.In order to seek the "maximum common divisor",the guiding role of the principle of common but differentiated responsibilities in reducing greenhouse gas emissions from ships needs to be clarified on the premise that countries have significant differences in economy,history and population.Moreover,from the perspective of system interpretation and environmental justice,the application of the principle of common but differentiated responsibilities in the field of ship greenhouse gas emissions reduction is also inevitable and reasonable.The International Maritime Organization plays an extremely important role in the separate legal regulation of greenhouse gas emissions from ships.At present,the International Maritime Organization mainly controls greenhouse gas emissions from ships through ship energy efficiency measures(including technical and operational measures)and market measures,among which the implementation of ship energy efficiency measures has a positive effect on controlling greenhouse gas emissions from ships.However,there are various barriers in the transfer of technological measures from developed countries to developing countries,which result in developing countries not being able to update relevant technologies in a timely manner.Moreover,the operational measures do not specify how shipowners should implement operational measures and the greenhouse gas emission reduction targets that ships should achieve,making it difficult for operational measures to effectively play their role.In market measures,due to significant disputes among all parties,the International Maritime Organization has not adopted market measures.However,with the deepening of relevant research and the improvement of legal systems in other regions,the implementation of market measures is imperative.However,there are currently uncertain and unfair issues in the main market measures.To improve the effectiveness of ship efficiency measures and market measures in controlling greenhouse gas emissions from ships,solutions have also been proposed to address the issues that arise between the two.In terms of collaborative legal regulation of ship greenhouse gas emissions reduction,based on the special relationship between ship emissions of greenhouse gases and atmospheric pollutants,it is necessary and feasible to carry out collaborative legal regulation of ship greenhouse gases and atmospheric pollutants.Collaborative regulation of ship greenhouse gas emissions reduction provides a new path for ship greenhouse gas emissions reduction.However,due to limitations in human understanding of marine climate change and difficulties in the development and cooperation of ship pollution reduction and carbon reduction technologies,there have been disharmony issues in the mechanisms for ship greenhouse gas emissions reduction and air pollutant emissions reduction.This mainly includes unclear legal nature of ship greenhouse gas emissions and controversial application principles There are three aspects to the imperfect emission reduction mechanism.To promote coordinated regulation of greenhouse gas emissions reduction on ships,it is necessary to examine relevant domestic and foreign regulations and propose corresponding improvement paths.In the implementation of ship greenhouse gas supervision,ensuring the effectiveness of ship greenhouse gas reduction not only requires complete legal provisions,but also an extremely important part of legal supervision and enforcement.International environmental conventions such as the United Nations Convention on the Law of the Sea(UNCLOS)grant flag states,coastal states,and port states the right to manage greenhouse gas emissions from ships.All three countries have achieved certain results in their specific work,but there are also some urgent issues that need to be addressed.Moreover,due to the inherent "soft law" nature of laws related to greenhouse gas emissions reduction from ships,some compliance issues have also arisen,Finally,some solutions are proposed to address these issues. |
