| Right of education punishment and discipline refers to a kind of education management right that teachers deploy reasonable and legal ways to exercise against students who violate students’ code of conduct and school rules in order to maintain the order and regular process of school education and teaching activities.In June 2019,the Communist Party of China(CPC)Central Committee and State Council published Opinion on Deepening Education and Teaching Reform and Promoting the Quality of Compulsory(hereinafter referred to as the opinions),which proposes to formulate implementation rules,clarify teachers’ right of education punishment and discipline,and resolutely safeguard teachers’ legitimate rights and interests.In December 2020,based on extensive researches and soliciting opinions from the public,the Ministry of Education formulated and issued Code of Educational Discipline for Primary and Secondary Schools(Trial Implementation)(hereinafter referred to as the rules).The study of primary school teachers’ right of education punishment and discipline will be conducive to fully implement the requirements of the opinions and rules,promote the quality of compulsory education in primary schools,help students grow in various aspects,protect teachers’ rights and interests and regulate teachers’ behavior at the same time.Self-edited “questionnaire on the current situation of the implementation of primary school teachers’ right of education punishment and discipline” and interview outline were randomly distributed through electronic questionnaires among primary school teachers in Hunan,Shaanxi,Henan,Inner Mongolia,Sichuan,Hebei,Hubei,Zhejiang,Fujian,Guangdong,Shandong and other provinces and autonomous regions.207 valid questionnaires were received,and the data of all questionnaires were processed and analyzed by SPSS 25.0.Five primary school teachers were interviewed,and the interview records were sorted and analyzed.The results show that the primary school teachers’ understanding of right of education punishment and discipline is vague,there lie differences in the assumption and application of educational discipline among primary school teachers,there are irreconcilable contradictions between individualization and collectivization in schools,primary school teachers are in an awkward situation in terms of the problem of educational discipline.Based on the results,this thesis analyzes the main factors affecting primary school teachers’ exercise of right of education punishment and discipline as follows.First,the national level: “the legislation of right of education punishment and discipline and the shackles of morality” and “unspecific formulation of educational disciplinary rules”.Second,parents and other external factors: “parents’ strong sense of protecting their children” and “the increasing pressure of social public opinions”.Third,at the school level,“the compulsion of school management and the inequality of the relationship between school and students” and “the lack of support for teachers’ disciplinary power”.Fourth,at the level of primary school teachers,“unwillingness to discipline caused by the weakening of their authority”,“a lack of knowledge about extreme behavior’s discipline”,“a lack of gut when personal safety is threatened” and“difficulties in discipline caused by the multidimensional nature of teachers’ work".According to the investigation results and analysis of affecting factors,this thesis puts forward the regulative strategies for primary school teachers to exercise right of education punishment and discipline from four perspectives.First,the country should formulate laws of educational discipline for primary schools and further clarify educational disciplinary rules.Second,the society should build a good environment providing relevant learning materials for primary school parents to learn and help parents correct their understanding of the right of right of education punishment and discipline,purify cyberspace and reduce the situation of defaming teachers.Third,the school should establish unique disciplinary rules for primary education,establish a mediation system of family supervisors,and establish an appeal system of teachers.Fourth,primary school teachers should strengthen the learning of teachers’ morality and disciplinary power with a positive “disciplinary attitude”,establish a concept of harmonious and equal education,and communicate with parents in time when exercising disciplinary power. |
