Study Of Administrative Examination And Approval System Reform

The third plenary session of the sixteenth Central Committee of the CPC proclaimed The Decision of CPC Central Committee on Issues Regarding Improvement of Socialist Market Economic System. The Decision said, the reform of administrative examination and approval system should be further carried out, in order to transform functions of government and thereby provide a sound and sustainable environment for the market economy. The words about reform of administrative examination and approval system thus frequently appear in the important documents of CPC Central Committee and Central Government. It shows that the reform has come to the focus of the nation attention. But the present state of such a reform can not meet the requirements. The reform faces many difficulties for a variety of reasons,for example,including the lack of theoretical guidance,disunion paces of central government and local government. The effect of the reform has not appeared obviously. This dissertation discusses the administrative examination and approval from the perspective of government regulation economics,administration theory and administrative law, in order to provide some useful guidance for the coming reform of the administrative examination and approval system.Due to the administrative examination and approval,government regulation and administrative licenses point to the same direction,they possess the homogeneity. To be convenient for researching this topic,government regulation and administrative licenses are regarded as the administrative examination and approval in this dissertation. The dissertation is divided into three parts: introductory remarks,text and concluding remarks. The text is divided into six chapters,(1) the theory of government regulation: theoretical base of the reform of administrative examination and approval system; (2) the reasons of the reform of administrative examination and approval system; (3) the experience and enlightenment from the reform of administrative examination and approval system abroad; (4) the basic conception of the reform of administrative examination and approval system; (5) the innovation of administrative examination and approval system; (6) the revolutionary reform of government by itself: the matching reform of administrative examination and approval system.Chapter â… : the theory of government regulation: theoretical base of the reform of administrative examination and approval system. Firstly,both conception of government regulation and classification are introduced in this chapter. Secondly,the rationality of government regulation comes from market failure,but market failure is not the sufficient condition to carry out government regulation. Because government is an economic man,it pursues its own interest. Government would be captured during the process of government regulation,and would lead to government failure. The conflict between public interest and sectional interest emerges when government defines the aims of regulation,from which the theory of Government is derived. This theory provides a better point of view to set up and execute government regulation policy impersonally and impartially. This chapter is the theoretical base of the dissertation.Chapter â…¡: the reasons of the reform of administrative examination and approval system. A conclusion, drawn from the analysis of evolution and abuses of the administrative examination and approval system,is of intergrowth relationship between the present administrative examination and approval system and the planned economic system. Though the administrative examination and approval system has been reforming and adjusting along with the transition of economic system,these efforts can not answer for the requirements of the improvement of the socialist market economic system,WTO entry and economy globalization.
