INTEGRITY" or "CREDIT' is the most important resource in market-oriented economic, especially in today's China. As feeing the terrific needs of credit in China, after considering other resolvements, such as ethical guidance and economic settlements, this thesis regards legal system is the most effective approach to deal with this problem. From reality and logic, using economic and logical methodology, comparing current legal system of credit, she them put forward LEGAL SYSTEM OF COMMERCAL CREDIT. The reason lies in two aspects: firstly, the character of the credit is becoming more and more propertized, the traditional legal system of credit can't keep accordance with this tendency; secondly, the credit is becoming more and more informational, but the traditional legal system of credit can't embody this change.After the establishment of the legal system of commercial credit, the thesis continues to approach the concept, category and system of commercial credit. Webber regards that law should accomplish two forms of rational - fonnly and substancially. After establish the conception system of legal system of commercial credit, the thesis has achieved the uniform of the two kinds of rational.Then, the thesis considers how to apply this institution into reality to resolve practical problems. From three different angles, this thesis raises the legal adjustment, the special realization and the social system engineering, hoping to "realize the law".In summary, facing the realistic problem of "lack of credit", through establishing the all-new legal system of commercial credit, this thesis creatively approaches the reasons. The approaches, the establishment and the realization of the system respectively answer the question of "WHY", "WHAT' and "HOW" perfectly.
