Research On Shanghai Chongming's Petition Mechanism In The Transitional Period Of Chinese Society

The petition always plays an irreplaceable role for hearing from the masses, resolving dispute, retaining social stability and a role as a bridge between the party and government. With China's entry into a critical period of reform development, various contradictions are revealed at the course of social transformation and mechanism transformation which makes the petition work faces unprecedented grim situation and institutional predicament. The author is a petition officer who is familiar with the petition work. Based on the author's limited experience and took the example of Shanghai Chongming'petition work, author will forward some shallow advice and measure for development of petition mechanism. Hope it can make benefit for the current petition work.There are six sections in this thesis. The first section is the introduction which mainly states the background of topic selected, research objectives, practical value, current situation of petition researching in domestic and overseas,and researching methods. The second section is about the concepts and foundational theories,and summarizing the theoretical foundation of petition work, the author proposes that the petition work should be strengthened and constantly improved. The third section is about the current situation of Shanghai Chongming's petition work, which mainly states the history about the Shanghai's petition mechanism, Chongming's petition organization and the current situation about petition mechanism. The third section will make it clear about the history of petition mechanism and current situation of petition institutions. The forth section is about the problems existed in Chongming's petition mechanism. Firstly, the author indicates the problems about heavy workload, limited power but heavy responsibility, the masses'cognitive biases. Then, the author reveals and deeply analyzes the reasons of the problems including backwardness of petition legislation, undefined orientation of petition organization, imperfect system and so on. The fifth section is about the domestic and international experience and reference on petition working mechanism. It provides a good example for current petition work by introducing the experience of Shengyang's petition hall, Swedish and Australian Ombudsman System. The sixth section is the most important part of this thesis which is about the methods and thoughts on improving Chongming's petition mechanism. This section suggests the new way of improving the petition mechanism and new methods of improving the petition work which with the basic of analyzing current situation and summarizing the contradiction, with the precondition of completing petition institution, with the crucial content of completing information analyzing, resolving the disputes, stabilizing risk assessment, finalizing the petition issues, with the guarantee of innovating petition informatization, low-level agency, lawyer's participation and so on, aiming to open the new situation of Chongming's petition work.
