To develop the circular economy is an necessary choice for China's sustainable development, which is the deepening and concrete of sustainable development. It is a complex and systematic project to transform from the traditional economic model to the circular economy model, needing to construct economic policies and a system of laws and regulations. The success experience of foreign counties shows that effective government policies and legal system is an important driving force and necessary guarantee for the development of circular economy.At present, According to the theory of sustainable development and the practical experience of the circular economy, developed countries have established a relatively perfect policy system, including preferential tax policies, environmental and resource tax, charging for waste and pollutants, implementing preferential loan policies, government grant system, government incentive policy, and so on. Although China has been doing some research in this field, compared with developed countries, there are considerable shortcomings. We can learn the successful experience from foreign countries, and in light of China's actual situation, to improve our policy system of circular economy.In addition to economic, administrative, and the market control mechanism, which constructed by flexible policy control means, they also make variable policies become state's mandatory binding legal form using legislative measures, forming a relatively complete legal system gradually, so that the development of recycling economy onto the track of the legal system. Germany and Japan have made a lot of prominent contribution in this field. At present, China has no comprehensive and integrated law to adjustment the circular economy, and the real law of the circular economic is still in the bud. We can learn the successful experience from developed countries, especially the experience of Japan, which is to develop circular economy Basic Law, establish the basic ideas about circular economy, then make special law in specific areas.At the end of this paper, it described the policy and law systems with an example of Shijiazhuang, and explored the much-needed policy measures of circular economy in Shijiazhuang.
