On Contemporary Corruption Actuality And The Building And Improvement Of Anti-corruption Scheme And System

Nowadays, corruption is a widely discussed topic in world. Corruption exists in every country to different extent. Anti-corruption became a hot word , which catches universal attention from governments, politicians, jurists and criminologist. The essential thesis in research of corruption is how to judge the corruption phenomenon of a country in different periods, and how to take corresponding measure and perfect legal systems based on the judgment. According to the austere position of anti-corruption in our country at present, this thesis will discuss corruption actuality, anti-corruption actuality and anti-corruption legal system in our country from four aspects, combined with basic rules in UN Convention Against Corruption and theories and practice in our country.The first part discusses the concept, character and causation of corruption, and the social harm caused by corruption. Derived from the three kinds of concepts of corruption in world and some viewpoints in our country, the author points out that corruption is the abnormal exertion of power. Corruption is a conduction made by people who has kind of public power, exerting the power in an abnormal way by self-interest, causing harm on the whole society. The author analyzes the common character and social harmfulness of corruption, then discuss five main causations of corruption in our country, which include consciousness, power-restriction system and social environment.In order to perfect our country's anti-corruption system, the second part analyzes the characteristics of anti-corruption system and the problems and disfigurements of anti-corruption organ settings in China, point out four suggestions of anti-corruption organ functions.For the sake of perfect legislation and techniques in investigation of corruption crime, in the third part, the author construes the characters and problems in investigation. The author indicates the requirements and implementation way of common investigation technique and high-tech. The procurator ate should combine different sources, enforce the function of integrative system, and change the investigation mode. Tending to prevent the corruption of anti-corruption civilians, the system of people supervisor in procurator ate takes an important role in theory and practice.In the forth part, the author suggests strengthening prevention function, enhancing the status of preventive anti-corruption institution. Considering the integrity of anti-corruption system, the author points out that legislation, supervision and international cooperation are vital to prevent and restrain corruption.
