Research On Amending Of "Archival Law Of The People's Republic Of China"

"The Archival Law of the People's Republic of China"(abbreviated as ALC)was amended by Standing Committee of the 8th National People's Congress in July 1996. However,"no changes to those provisions which are unnecessary to amend"being held as principle, the amendment by then was actually quite limited and superficial. As the new Millennium comes, national archival affairs and condition are both varying thoroughly on either the format or the essence. Especially the"Government Information public regulations of the Peoples Republic of China", which was published in January 2007 and has been executed since May 2008, is actually pushing forward the"ALC"as a"back-to-forth"drive on its legislative philosophy and archives management details. Meanwhile. many Electronic Record were produced in the last decade, which has taken nearly more than half in quantity of the total archives in some certain industries and units, or even much more than traditional Paper Record. But"ALC"concerns nothing at all on such Electronic Record, which leads to the result that archives management has been far behind its present condition. As per the analysis to many cases reported by some professional journalism, there are also many problems on archives administration and execution. Consequently, ALC needs urgent modification. At the last section of this thesis, scope and mode selection of archives legislation between China and foreign countries are also compared and analyzed.
