It is inherent requirement of a government governed by the rule of law and the basic connotation of a responsible government to keep right with responsibilities. Being part of a responsible government, the institution of taking blame and resignation is helpful to strengthen the government's duty, improve management of civil servant system and promote public administration according to law. It provides a way to keep a good government image and achieve social harmony.With the development of government reform, institution of taking blame and resignation is attracting extensive attention over recent years, while it has already on the way of design and implement. The approach of this institution in China shows characteristics that practices precede legislation, local policies precede national regulations and rules of the Party precedes governmental legislation. Although having been taken into legal areas in Civil Service Law of the People's Republic of China(2005), the institution of taking blame and resignation is far from prefect because of defects in legislation, social attitudes and supporting measures, which has already lead to deficiency and problems in practices. This paper tries to study related theoretical and practical topics of the reform of institution of taking blame and resignation from the angle of law. It analyzes the conceptions, content, theoretical basis and functions of the institution. And it generalizes problems in legislation, system design and practices. According to the theoretical conclusion and comparative analysis, the paper explores advisable countermeasures to improve institution of taking blame and resignation in China through social attitudes, legislation and corresponding mechanism.
