Self-administration by law is not only an elementary right of a primary and middle school, but also an important part of modern school administration system. School is irreplaceable in education law relations, thus independent administration by Law should be a legal principal of running a school. The old administrative pattern that government and education department have the initiative of running a school, take direct and all-round control of a school by administrative measures, is not in favor of fulfilling the juridical person status and independent right of running a school, not in favor of the shape of characteristic of a school, and also not in favor of the settlement of many educational hot and difficult problems.As an important part of modern school administration system, the outstanding characteristic of self-administration by law of a school is to limit the right of government in control, supervise and instruct a school. The main point of boosting self-administration by law of primary and middle schools is to confirm the administration right of education departments and schools according to law, arrange the relations between government and schools, fulfill the juridical person status of schools. Education department should lay down more right, enhance the macro-management, in order to create a good exterior environment for independent administration by law. Primary and middle Schools should establish constitution and regulation system, consummate interior administration system, in order to realize a well-ordered, characteristic, self-administrate, self-restrict and self-development system. In recent years, Qingdao hammers at advancing self-administration by law of primary and middle Schools and have gained good effect. But there are some problems can't be ignored that have adverse effect on the work. The key reason is the function of education departments haven't transfer their functions completely. From education departments to schools, the cognition on the important meaning of self-administration by law should be enhanced, and the interior administration and running system of schools should be improved, and the ability of self-administrate and self-development of the schools should be enhanced. In addition, incomplete related policy and invalid inspiring system are also the reasons that affect the work.In the future, in order to advance self-administration by law of primary and middle Schools, we should start with partition the purview of education departments and primary and middle schools, and nail down their right, duty, benefit and the right of self-administration by law of primary and middle Schools. Based on this, we should further consummate the work system of enhance self-administration by law. As macro-level is concerned, it's necessary to transfer the function of education departments, intensify their function of planning, legislation and executing the law, enhance their ability of macro-management, decrease their direct interference to schools; it's necessary to enhance the ability of self-administration by law of education departments, consummate the system of executing the law, enhance the efficiency of administration; it's necessary to constitute a favorable education estimate system to lead education departments consciously fulfill the right of self-administration of schools, to lead schools function their self-administration right actively to enhance the characteristic and benefit of running a school. As micro-level is concerned, it's necessary to consummate the system of interior self-administration of schools to guarantee the validity of school behavior; it's necessary to exert the positivity and creativity of all the teachers and the staff, and establish interior democratic administration and supervision system, to accelerate the standardization and scientification of school administration.
