China' s migrant children schools are the products of the insufficient resources for public education. It helps to solve the problem of compulsory education of migrant children, and reduces the pressure of the city's public schools in an objective. The central government requests the inflow government to carry on assisting in the transient population children school, to ensure that the peasant laborer children accept the compulsory education equally, which brings up a new task and request for the government' s public administrative action. In recent years, Ningbo City, mainly through public schools to private, the public office help, public schools, supplemented by migrant children to do, basically solved the migrant children "the chance to read" problem, but there are still significant differences from the school quality of the three types of schools.This paper covered a large number of detailed data and resources of migrant children schools in Ningbo City, according to surveys and interviews. Through the research, we found that Ningbo Municipal Government had strengthened the management responsibility of the inflow governments, improved the effectiveness of the migrant children schools by way of institutional innovation and increasing investment, thereby, it had saved the migrant children's education benefits, make up the deficiencies in the market mechanism . However, the increasing growth rate of the floating population children makes county-level governments face financial pressure, on the other hand, the Government' s positive intervention conflict with the private-run migrant children schools in the school system. In addition, the lack of education fund makes private schools face new challenge.In this paper, from the standpoint of law, educational sociology, the author analyzed the questions which existed in the migrant children school. The author believes that the reasons for these problems include not only the inadequate fund for education and uneven allocation of resources, but also some deep-seated institutional reasons behind the education. From the real world point of view, the country is short of the necessary policy to support the development of migrant children schools, the unclear objectives of public policy lead to the implement bias of inflow government, resulting in conflicts of interest between the Government and the school, roles conflict and unclear property rights.In this paper, the author used public management theory, public goods theory and educational principles of economics, to bring up the policy choices of Ningbo City migrant children school, the general ideas and the specific measures. This study suggests that migrant children school is the product of the transition period. Inflow government should take a positive responsibility during the transitional period, and insist the principle that government investment acts as the mainstay, supplemented by market operation, lead the non-governmental organizations appropriately, save the public nature of the migrant children schools as much as possible. In particular, it can be started from several aspects: First, revise the management practices to promote the healthy development of three types of schools; Second, build a mechanism for the healthy development of the floating population children' s school; Third, play the balance role of the mobile population children' s school associations between the government and private schools.According to the research, in the condition that our country has not yet set up a perfect adaptation to the mobile population to accept the admissibility of education system, facing and solving problems of the migrant children schools, is related to not only the children of their own growth and self-realization, but also the relationship between the country' s modernization and urbanization, sustainable development, which has a certain reference to the role.
