An Analysis Of Rights And Interests Protection For Land Lost Farmers

With the rapid development of economic and society in China recent years, the levelof urbanization is rising rapidly. Land occupying, as a necessity of city development,causes land requisition becoming increasingly frequent, which have resulted in farmers'leaving the land and becoming the "land-lost farmers". Problems during the landrequisition, such as farmers' survival and development not being settled, low compcnsationstandard, unreasonable land incremental profit distribution and farmers being excludedfrom the benefit of urbanization, have resulted in the contradiction between the great landincremental profit and land- rcquisitioned farmers' benefit. In the era background ofbuilding harmonious society, how to protect the land-lost farmers' rights and interests, to letthem share in the benefit of industrialization and urbanization, is a significant task.Based on the analysis of the policies of land requisition and relocation, and the fieldsurvey of the land-lost farmers' evaluation on the present systems and public policies ofland requisition and transfer and benefit protection, the paper aims to examine the farmersneeds and aspirations of system innovation. And based on the value judgment of how toprotect farmers sharing in the benefit of industrialization and urbanization, the paperproposes the idea and method of how to compensate land-lost farmers, builds policysystems of benefit protection. Hence, it will provide theory and policy support for thestrategic goal of coordinating urban and rural development.Firstly, thc paper reviews the relevant literature and analyses the development ofprotection systems of land-lost farmers and the reasons of farmers' interest loss. On thebasic analysis of the actuality of the comparatively unbalance and serious disjoint landsystem construction of urban and rural, the paper reflects the land transfer systems whichhavc bereaved farmers land development right, and then puts forward the value judgmenton how to protect farmers' sharing in the benefit of industrialization and urbanization.Secondly, taking Nanjing as an example, the paper analyses the rapid increasc of land demand caused by society development and city expanding. Based on the survey of theland -lost farmers benefit protection policies, the actuality of land requisition andrelocation, and the characteristic of land-lost farmers, the paper values the relevant systemsand public polices of land requisition and transfer, and examines the farmers' needs andaspirations of system innovation.Thirdly, on the basis of theory analysis and field survey, the paper puts forward theidea and method of how to compensate the land-lost farmers, and on the basis of the valuejudgment of how to protect farmers sharing in the benefit of industrialization andurbanization, the paper builds the policy systems of benefit protection for land-lost farmers.Lastly, the paper summarizes the main conclusions and prospects the direction of thefuture research.
