Study On Shift-and-Renewal Problems Of Rural Workers' Endowment Insurance In Law

As the major force of China's modernization drive, rural workers have contributed the tremendous strength for economic and social development of our country. They have devoted their prime of life to industrialization and urbanization. In order to meet the needs of"A secure old age", they cherish a hope of owning reliable endowment insurance as their urban counterparts. A survey concerned rural workers'social security in coastal areas has shown that, they have a strong will to join in the endowment insurance system. Though, the problems of rural workers'endowment insurance have gained much attention from both central government and local governments, some policies have been set up successively. Recently in some developed regions in China, rural workers in some enterprises have been brought into the social insurance system. However, on the contrary, the phenomenon has appeared that more and more rural workers have withdrawn the endowment insurance at present time. This has become an urgent problem in our social life, which is not only related with the issues concerning agriculture, rural areas and farmers, the social security right of rural workers, but also with the strategy in balancing urban and rural development and the construction of the harmonious society. At the same time, the problem is also a challenge to the system of rural workers'endowment insurance. There are many factors contributing to the problem, but the direct reason is the shortage of shift-and-renewal legal mechanism.This article analyzes the shift-and-renewal problems of rural workers'endowment insurance from the following six parts. The first part is introduction, which states in details about rural workers. Firstly, the author analyzes its concept, characteristics, then introduced the purpose of this article. The second part states the current situation about the shift-and-renewal of rural workers'endowment insurance from policies in our central government as well as in different local governments to practical operations. Then this part still analyzes the existing problems and their reasons. The third part states the necessity of the shift-and-renewal mechanism. The fourth part mainly carries on the introduction to the shift-and-renewal mechanism of foreign endowment insurance legislation situation and their endowment insurance system. The fifth part comments on the"Act of Rural Workers'Endowment Insurance", the author analyzes the routes to establish the shift-and-renewal mechanism for rural workers'endowment insurance. The sixth part is conclusion. It is about legislative suggestions. The author's proposals are as follows: work out unified methods for rural workers'endowment insurance by The Central People's Government of The People's Republic of China; upgrade management of social security funds to national-level authorities; establish unified, effective shift-and-renewal mechanism, etc.
