College student power is not only an item of important powers in advanced education system, but also an indispensable part of legal rights of students. Higher education in China has entered upon a mass seedtime. With the advent of another peak period of development, it indicates the characters of the inconsistency emergent period as well. College student is the kernel factor which affects the advancement of higher education and the begetting inconsistency. College takes on the important task of bringing up capable persons in higher education activities. In addition, it is also an institution where conflicts of rights occur most easily between themselves and the students. Rights conflict between a college and any private student is easily to become the conflict between a college and the student's community, having extensive social effects.Nowadays, inducement of losing rang of student rights dose lurk around in Chinese higher education. Campus upheaval happened in Japan and some other countries in 1970s cautioned us a lot. In practice, the problem of student rights has not drawn enough attention of people. How to respect and protect student rights faithfully, advance it within law scope and avoid losing of range has been a problem that has to be studied and resolved.Based on the existent research, my thesis focuses its attention on distinguishing the relationship between student's power and rights, opens out the law of student rights advancement from history angle, analyses problems existing at present, and tries to propose countermeasures and suggestions to settle these problems. My paper mainly adopts the ways and means of theory analyzing, history analyzing, comparison analyzing, and research, trying hard to think over questions in the angle of multi-subject.By means of research, conclusions are elicited as follows: First, the multi-identity of college students gives them multidimensional power and rights. Both substantial differences and closest link exist between college student's power and rights. Though legal rights contain legal power, it is possible that student power may shake off the control of rights, being abused willfully. Second, college student power takes up a very important but not dominant position in the whole power system of a college. Third, higher education indicates that college student power has taken on an up and down character and has been advancing, more and more, centering on its legal rights. Fourth, college student power is provided with the effect of protecting rights of students themselves. Moreover, it has great significance of caution. Last but not least, educators should set correct value on student and student rights; student power should be provided with correct guide, regulation, and laws; besides, good student organizations should act as safeguard in the student's power advancement.
