In this era of social and educational transformation, the compulsory education is mandatory, free of charge and popularized, which has been recognized by law at the very beginning of this new century. This orientation requires relevant supporting policy systems, of which attending nearby school is an important part. In the process of modernization of various countries, compulsory education is considered as a basic educational system to improve the quality of their peoples. It is a top priority for governments to make this system achieve their political intentions and social benefits in a more efficient way. In light of compulsory education development history, most of those countries adopted the policy of attending nearby schools. However, because of differences in those countries'historical backgrounds, national systems and cultural traditions and so on, there are some differences in addition to common features when they implement this policy.Promoting equity has been proposed in National Medium and Long-term Educational Reform and Development Program (2010-2020) as a national basic educational policy. Educational equity is an important basis for social equity. The basic requirement of educational equity is to ensure citizens'right to education in line with law; the key point of this issue is equal opportunity; the focus is to promote balanced development of compulsory education and support disadvantaged groups; the fundamental measure is to reasonably allocate educational resources so that rural areas, remote areas and ethnic regions can enjoy more resources, by which the gap of education in different areas can be narrowed. The government shall shoulder the main responsibility in promoting educational equity while the whole society should work together to promote equity in education. As a basic measure to guarantee equal educational opportunities, the policy of attending nearby schools has direct influence on Children'benefits.In order to achieve national educational goals and consolidate and develop compulsory education, corresponding laws are needed and the timely adjustment should be carried out in the policy of attending nearby schools. Yet how to adjust this policy to better reflect and achieve compulsory education's features– mandatory, free of charge and popularized? This paper will analyze the issue of attending nearby schools in rural areas in China from the perspective of educational policies and law. However, there are some problems and difficulties in the implementation of this policy in rural areas. They should be solved. What is the history of the development of this policy? Which factor should children attending nearby schools base on? The place where their Hukou is registered or the place where they live for a long period? How to deal with the problems of cross-administrative enrollment caused by entering nearby schools? What does―nearby‖refer to? If a child has to attend a distant school, what are the necessary supporting measures? This paper will discuss the above-mentioned issues so that the function of public welfare of compulsory education can be better demonstrated which will further improve the development of compulsory education in rural areas. Through this way, balanced development of education in rural areas and urban areas can be accomplished and educational equity can become realized.
