The Discussion About The Construction Of The Oiffcial’s Comeback Mechanism Which Is Based On The System Of Administrative Accountability In China

The construction of the system of the official’s comeback after one’s administrativeaccountability is a significant task for the socialist construction during the new period. It helps toperfect and improve the construction of the administrative accountability system. It is anindispensable part of the construction of the administrative accountability system and has greatsense on the construction of the team of Communist Party member and the construction of thewell-to-do society.My dissertation mainly discusses the construction of the system of the official’scomeback.Centering on the issue of the official’s comeback which is on the premise ofadministrative accountability, it discusses the theory of the construction of this system. It suggests:we should construct the system with the guidance of responsible government and Service-orientedgovernment, with the aim of strengthening government’s public trust and improving thegovernment’s ability to perform its duties and ability of serving the people, with the principle ofvaluing scientific methods, public opinion,people’s livelihood, open and justice, with the purposeof making the official learn from past mistakes to avoid future ones and educating them. Thisdissertation emphasizes the normative, lasting effect, practicability and systematicness of thesystem. For the first time this dissertation puts forward the idea of improving the credit of theofficial and promoting the official’s public trust after administrative accountability, which providesguarantee for the construction of the team of the Party member, the Party’s ruling ability and thepurity of the Party. My dissertation proceeds with researches of the problems of the official’s comebackafter one’s administrative accountability, which are made by domestic scholars at present, itdefines the concept of system of accountability, system of administrative accountability, official’scomeback and other related concepts, according to all the above, it summarizes the accurateconcept of the system of official’s comeback and analyses the characteristic of the system. Themiddle part of this dissertation analyses the problems in official’s comeback, these problemsinclude:the reasons why the official can be back are not clear and the processes are not open; theprocesses of official’s comeback lack reasonable and legitimate system; there is no clearregulation of when the official can come back after one’s administrative accountability; there aredifferent ways of comeback, its lack of standardization weakens the use of the administrativeaccountability system. Also this part points out the reasons of these problems, the reasons are:legal system is not perfect enough, causing that the comeback is lack of legal basis; the system ofcomeback is not good enough and its lag; the supervision mechanism is weak; the people don’ttake part in actively; there exist different cognition between people and government; the effect ofChinese traditional civilization. Following this part, the dissertation tries to put forward a new pathof this system construction, makes clear the purpose of the system construction. It points out thenormative of the principles, conditions, processes and time limit that official’s comeback shouldhave and sketch the flow chart of the construction. What is more, this part puts much importanceon the analysis of tracking evaluation mechanism, the accountability mechanism of official’sillegal comeback, social supervision mechanism, mechanism of error correcting andpunishment,mechanism of improving public trust and the construction of the mechanism of theParty’s working style and a honest administration,lifelong learning, and contemporary political culture.The end of the dissertation prospects the system of comeback and points out thedeveloping trend is the generalization of the right to know, a wide range of Participative Subject ofsupervision, and the democratization of comeback.
