Analysis Problems Of The Rural Left-behind Children Care

With the urbanization’s developing in China, the increasing number of surplus rural labor are flowing to urban. These migrant workers get jobs in cities, while the vast majority of the people can not afford to let their children to study in the city schools, their children are still studying in rural areas. Therefore, a new disadvantaged groups-derived from left-behind children in rural areas, which leads to the problem of the custody of the children left behind. These children are away from their parents, they are lack of guardianship, which leads many unfavorable factors to their healthy growth, meanwhile, their legitimate rights and interests are not well protected. This paper firstly analyzed the status of the custody of the children left behind in rural areas, defining the relevant concepts, and analysis of the law about the custody of rural children left behind at this stage, meanwhile, analysis of the custody type about these children; the same time, this paper also analyzed the problem of the custody of these children, including that the lack of legal guardianship, the guardian duties is unknown, the weakening of parental responsibility and commission custody imperfect mechanism,the absence of state responsibility, the lack of effective guardianship monitoring mechanisms. As well as, this paper induct and comb reasons for the problem that the lack of custody of children left behind in rural areas, then put forward countermeasures and suggestions to solve the problem of rural left-behind child custody laws, mainly through building the perfect children left behind guardian system, while building and strengthening of rural children left behind national care system and the left-behind children in rural areas care oversight mechanisms to protect the legitimate rights and interests of the children. Finally, achieve the purpose that the rights of children left behind can get the maximum protection, their physical and mental health can get better growth.
