Responding To Risk Society

The development of the globalization makes the risk have a global trend. The influence in breadth, depth, dangers is far more than any other time in history, including in our country. Risk society makes new challenges to the ethical and legal issues. And it became more and more serious. And current ethical system and legal system can not cope with such high risk. The moral system and legal system need to be refined to cope with them, in response to the moral and legal issues in our risk society.In order to get the meaning of risk society, Chapter I analyses the risk society. It first quotes the description and definition of the risk society by Baker, and define that the risk studied in this paper is modern risk, which has characteristics such as humanity, uncertainties, etc. And it analyzes the significance to deal with risks by risk society theory as well as the relationship between risk society and social risks.The second chapter describes the significance of the ethical and legal responding to the risk society. They play an important role in dealing with the risk, and they are inseparable with each other. This article describes the relationship between the ethical and legal, and explains the significance in response to the risk society by moral and laws separately.Chapter III describes the objections of the moral notion and legal system in response to the risk society. It summarizes the moral and legal measures coping with the risk in our country, and points out the existing problems, Lack of moral beliefs, the damage of the moral environment, legislative defects, law enforcement drawbacks, loopholes in supervision and judicial problems.Chapter IV, as the key part of this article, describes measures to deal with above issues. On the aspect of morality, mainstream moral consciousness should be cultivated and corresponding adjustments according to risk society are expected to make due to the pluralistic impact of value on moral concepts. The measure of improving social, school and family environment should be taken to deal with the issue of moral environment. The moral model should be converted to cope with the disadvantages in moral education forms for the performance boost on moral education. In legal aspect, People-centered and rights-based legislative concepts shall be established. The national executive accountability system shall be built specific to the problems in law enforcement. The supervision system is in the hope to perfect on the account of its problem in administration. To develop the role of judicature aids to solving the relative matters in risk society.
