Empirical Research In Irandling Criminal Cases By The Police Station Of C City

From the current laws and regulations, handling criminal cases isn’t main business of the police station, nor the specialty of it. But in the enforcement practice of law, police station in many parts always undertake more missions than other departments of police (C city is the case in recent years).As the dispatched office of police, the police station has a variety of functions, including public security preventing, social administration, fighting crime, serving masses and so on, which makes the police station increasingly complex and changeable in handling criminal cases. What are the major criminal cases handled by the local police station? How does the police station handle criminal cases? Which mode of criminal investigation could give full play to the police station’s advantage of "familiar with the people and area", making the fight against crime more powerful? What kind of performance appraisal is more incentive to the police station to criminal investigation? The real problem is not only related to the system of police and the mode of investigation, but also affects the perfection of criminal procedure and the development direction of the police station.This dissertation chooses the reality in handling criminal cases by T, Q, N police stations of C city as the research object, demonstrating how does the police station of C city handle criminal cases through a large number of first-hand information(including internal data, the investigation record of three police stations, interviews with polices, residents, government staffs). Firstly, this dissertation introduces the general situation of police stations in C city, including distribution, quantity, police system and external relations. The second part of this dissertation carries out an empirical analysis on handling criminal cases by T, Q, N police stations and it thinks that the major criminal cases are theft, intentional injury, drug trafficking. More existing cases, minor influence, mild punishment are the characters in handling criminal cases. The third part has analyzed the problem in handling cases, including:the criminal investigation mode and the police station system impede the investigation of criminal cases; performance appraisal is not reasonable enough, strange phenomenon in investigation has arisen under pressure system, such as "handling the case in accordance with the assessment targets instead of occurrence regularity of the cases","artificially split case","don’t prosecute on time", even making fake cases; current criminal procedure is uncoordinated with the characteristics of handling criminal cases in police stations; the quality of personnel and other issues. Finally, the author believes that the "area investigation organization" is more conducive to crack down on crime and crime prevention, on the one hand the "area investigation organization" bears main investigation missions; in the other hand, the police station works for social management and crime prevention. But both must build reasonable structure, mechanism, majority of investigation missions can not be assigned to the police station, the assessment should be providing effective clues for handling cases. The author also believes that it is necessary to explore the procedure suitable for primary investigation organizations, such as quick-decision mechanism.In addition, the author also puts forward own suggestions for converting investigation concepts, enhancing the quality of personnel and perfecting the relevant procedure.
