Discussion On Legal Problems Of Resettlement Villages

In the process of the reconstruction of villages within the city, the famers’ right of usingthe house-based land was confiscated. And the attached houses were pulled down andremoved. The reconstruction of villages within the city means the re-distribution of the landinterest.This essay analyses the meaning and three modes in the practice of reconstruction ofvillages within the city first, and argues their advantages and disadvantages in detail,expressing the author’s worry about these modes.Then taking the mode of Liede Village, Tianhe District, Guangzhou as the visual angle,the author contrast it with three common mode. And draw a conclusion that this kind ofconfiscation of the right by the village collective economic organizations with the wholereconstruction mode is worth learning by other places in a certain range and under the certaincondition. However, r we must respect the local realities and correct or adjust it during thereconstruction process.Finally, as for the resettlement issues which emerged in Liede village reconstruction,there is still no clear legal procedures and detailed substantive rules to regulate collectivelyowned land on the housing resettlement issues in our country. Under the practice ofreconstruction of the villages within Guangzhou, this paper analyzes the practical laws ofrelocation disputes in the reconstruction of villages within the city, and tries to conceive theways of relief. We should enact the confiscate laws. Through the legislative review function,we can confirm the higher level people’s congresses and their standing committees toguarantee the public interest, and improve the villagers’ ability to express their right ofinterest. So we can build and make the systems such as employment of the villagers andsocial security perfect.
