Research On The Legal Protection Of Energy Ecological Security

There is a close relationship between the energy, economy and environment.Since the industrial revolution, the use of fossil fuels has promoted the rapiddevelopment of economy and caused serious environmental problems and globalclimate change, threatening the survival of mankind. Although China has establishedlegal protection system of energy ecological security, the system is not perfect andlack market rules; there are not more attention to energy ecologic and environment. Itcannot be effectively modulated to destroying the ecological environment throughoutenergy development and utilization. Resulting in more serious problems of energyecological security, fog and haze is frequent. Facing of severe environmental situationand climate change, the human development concept began to change from one-sidedpursuit of economic growth to sustainable development. Under the influence of which,energy law is experiencing a green tide, people put more attention to the energyecological security and sustainable development. In the process of greening energylaw, the developed countries preceded one step, they have already established aperfect legal protection system of energy ecological security. China should learn thesuccessful experience from the developed countries in the energy legislation to draftenergy basic law and improve the energy special law, the energy relevant law andenergy complete regulations. The perfect legal protection structure system of energyecological security which put the constitution as the legislation basis and the energylaw as the basic law, constitute of complete the energy special law and the relevantlaw, follow up with the energy complete regulations will be set up. The legal systemof environmental law and economic law should be introduced into the energy lawduring improving energy law to structure the new energy legal systems, making thesystem become the organic constituent part of the energy law. Meanwhile the originalunreasonable energy legal system will be improved. This paper mainly focuses on thelegal systems of adjustment of energy structure, energy efficiency standards and logos,the building energy conservation, clean energy and carbon emissions trading and soon. Improved energy law should mix together with environmental law and coordinatewith the market mechanism to realize change of energy law from the attributes ofproperty law and administrative law to the attributes of environmental law andeconomic law, so that the energy ecological security is better protected.
