Obtain employment, as the people’s livelihood, has a close connection with everyonein the society, what directly impacts on the stability and development of the society.Female, who is the main force of the social development, plays an important role in thehistorical process. In recent years, gender differences in employment have a huge impacton female employment. We use male’s standard as the law’s rule, which makes the maleright words, and what is difficult to lead the female employment right to seek effectiverelief. Therefore, we need to create a good employment environment for female, andprovide effective legal guarantee. Female can get a stable economy, a higher social status,and promote a rapid, comprehensive development of society only if female enjoys andexercises the right.This paper is based on the theory of gender equality and human rights. Right ofequality is a basic right in the modern society. The theory of gender equality discusses thebasic contents that female has the same equal right with male in the employment. Femaleequal employment right is the same as human rights, what is the right that people enjoys.Article provides the foundation of female equal employment right protecting by definingthe right of equality. Though classified the institutional defects in the legal protection andthe discrimination in the practical operation female is faced with heavily discrimination,and there is lack of law protection about their right. Here, analyzing the reasons of lax rightprotection from the angle of history, economy, law and female themselves reveals the rootof right protection absence. Based on the reality employment in China, we reference theforeign advanced experience to explore an effective path of the female equal employmentright protection. We should establish the legislation in female equal right to employment,make an anti gender discrimination in employment, make up the loopholes in the law toprotect the female right; perfect the legal relief mechanism to make sure the law does notbecome a mere formality, break the existing pattern of employment; enhance socialregulation to break the existing pattern; strengthen female quality and right consciousness,develop the gender culture.Female equal employment right protection is not only about female themselves, alsohas a great impact on social development. Therefore, we should reallocate all the societyresources to effectively curb the gender discrimination in the employment and make theequality between of the sex come true through the long efforts.
