The Government’s Response To NIMBY With The Perspective Of Good Governance

With the reform and opening-up policy are been deepening day by day and the steps of modernization construction to be strengthened in our country, People’s living standards is higher and higher.The government needs to build a large number of public facilities to meet the requirements of people’s spiritual and material life. For these public facilities, Some of them can bring people physical and mental pleasure, such as:Library, open swimming pool, etc. Some of them are refused by people,such as A funeral home, incinerator, etc. Although people know that the Government builds these facilities for serving the public,because these facilities have negative impacts,such as:pollution on living environment and the depreciation of the property value, etc, people always fight with the Government whenever they build such facilities.Such phenomenon called "NIMBY" happens often in our country recent year. NIMBY happens with the development of cities,more and more scholars and experts focus on it recent years. How to solve it?it also challenges to the government.There are seven chapters in this paper. The first chapter is Introduction that mainly show the research status at home and abroad about the NIMBY and introduce the research methods and roadmap as well as the innovation and shortage about this paper. The second chapter through the method of literature analysis,defining the definition of Not in My Backyard,NIMBY facilities and NIMBY Conflict by reading a lot of domestic and foreign scholars related papers. Meanwhile, the support theories for this paper:the theory of Good Governance and the theory of network governance are discussed.The third chapter,Under the background of "new type of urbanization construction in China",analyzing the reasons why NIMBY happens and these reasons are:Economy, policy and psychological reasons.Meanwhile,analyzing its positive and negative effects. The fourth chapter is the core part of this article, with two cases:Hanyang district Guoding mountain wastes incineration factory and the Government of Guangdong Huazhou Ligang town builds funeral home,discussing deeply the difficulties when the Government deals with the NIMBY in the interest and value chain:NIMBY becomes NIMBY Conflict and the Government cancels the facility construction passively. As well as,analyzing deeply these reasons why the Government has difficulties to deal with the NIMBY.These reasons are:the lack of risk information, the community organization only for themselves, the first impression about NIMBY are strongest, the lack of legal relief system about environmental protection, the hysteresis in the Government’s decision system, the Government and the Enterprise are mixture.The fifth chapter,Through the method of comparative analysis,getting the enlightenment that how the Government deals with NIMBY by analyzing these ways that the American Government deals with the NIMBY. The sixth chapter, combining the actual reasons that NIMBY happens in our country and the actual difficulties that NIMBY happens in above two cases,getting the Network Governance mode is the way that the Government deals with the NIMBY. At the same time, this paper points out that it can reduce the possibility of NIMBY becomes NIMBY Conflict by building the compensation mechanism, the aggrieved legal relief mechanism and the cooperation governance mechanism. By establishing the scientific principle in decision and the principle in opening risk information to the public to reduce the public the first bad impression to NIMBY Facilities.The seventh chapter is the summery for this paper.
