Study On Village Official’s Land Corruption Problem

With the rapid development speed of urbanization, the use of urban land tends tosaturation and the demand for urbanization land constantly turns to rural collective land.Meanwhile, the value of rural collective land is gradually increasing and village officials whodo not have high quality begin to seek the personal gain from the collective land and step onthe corruption road in order to gain much money from the land. It makes people stunning thatthe number of land corruption cases is continuous rising high and the amount of corruptionsum is constantly refreshed and village officials’ land corruption has apparently become ahigh incidence area. Village officials’ land corruption seriously violates the benefits ofvillagers and collective groups and undermines the image of the party and the government，which makes people disgusted about this corruption. Therefore, fighting with the villagerofficials’ land corruption is imminent and government should insist on the policy fight theTiger and Flies together under the background of anti-corruption.Village officials do not belong to the national executive staffs because our countrycarries out the villagers’ autonomy regime. Thus，village officials’ corruption has somethingspecial when compared with other national executive staffs. The weakness of villagers’autonomy and loss of power supervision become the main reason of land corruption. In termsof the specialization of villagers’ corruption, this thesis will summarize the phenomenon ofvillager official’s land corruption, seek the causes of land corruption and try to find outcountermeasures in the perspective of villagers’ autonomy.This thesis firstly gives the definition of village official, village official’s corruption andvillage official’s land corruption, states the embodiment of villagers’ autonomy andsupervision system and points out that land corruption are actually illegal behaviors whichinclude illegal land retention, illegal land development.Secondly, this thesis summarizes the kinds, characteristics and hazards of land corruptionthrough visiting experiences and case analysis. Village official’s land corruption main reflectsin the aspects of retention of the land requisition, ignoring villagers’ wish about transferringland gaining the benefit from homestead allocation and transferring collective land andinfrastructure illegally. Among these aspects, the removal districts are the heaviest corruptiondistrict with the characteristics of various criminal devices, increasing corruption money,tendency of group corruption and high concealment. These corruption phenomena harm thebenefits of villagers and destroy the harmony of society.Besides, this thesis mainly analyzes the causes of land corruption in the perspective ofvillager autonomy system. Villagers’land corruption phenomena are caused by many factorswhich include inadaptability of village officer’s political quality, incomplete rural collectiveland ownership system, deviation of village election from public opinion, nonstandard ruralvillage affairs democratic management, weakness of autonomy of villagers’ democraticsupervision, lack of supervision and superior judicial supervision etc.Finally, this thesis comes up with corresponding solutions in terms of the villagers landcorruption which include carrying out anti-corruption function of ideological and political education, promoting collective land ownership system, promoting collective land requisitioncompensation system, strictly regulating the village election system, improving the autonomyof villagers democratic management, strengthening the villagers democratic supervision andpromoting treatment mechanism about judicial organs’ village official corruption cases.
