On The Prevention Of Domestic Violence Against Minor Children

As one of the hottest topics extending to the whole world, family violence has beenstudied in depth in the prevention area. China began focusing on domestic violence in1995on the World Conference on women. And the related works and researches of the scholarshave also come out in succession. Because of this, much attention has been put onto theprevention study of domestic violence to women while the domestic violence to minorchildren has not gained enough attention. Family, one of the most important places for minorchildren to grow, should become a place with good education and protection for them, but thereality is not as so. The phenomenon that minor children in family suffer the domesticviolence by their parents or the other family members is widespread. However, for thetraditional concept most people do not regard the underage child as an independent individual.The domestic violence to minor children is often thought to be just as the internal familyproblems, which does not infringe the rights and interests of minor children. At the same time,the establishment of the relevant legal system in our country did not take the characteristicssuch as the physical and mental immature of the minors, their limited capacity and so on intoaccount, which leads to the legal remedy providing for minor children suffered from domesticviolence lacking of pertinence and not making effect timely and efficiently. Therefore, it isnecessary to carry out the researches on domestic violence prevention for minor children.With the topic of “the Research on the domestic violence prevention for minor children”,this paper sets typical cases as the start point and is divided into six parts.The first part proposes the problem. By introducing a typical case of a minor childsuffered from the domestic violence, it brings out the legislative and judiciary problems aboutthe defense against the domestic violence to minor children in our country.The second part is an overview of the domestic violence. This part defines theconnotation of the domestic violence to minor children and analyzes the characteristics of it.The third part is the analysis of the present situation and the causes of the familyviolence to minor children. It introduces the present situation and the causes of the domesticviolence to minor children combined with the empirical data.The fourth part is about the legislations of the domestic violence prevention for childrenand the comments for these legislations in some other countries and regions, including Japan, USA, Canada and Taiwan.The fifth part illustrates the legislative and judicial shortcomings about the domesticviolence prevention for minor children of our country.
