Researching The Legal Safeguards Of The Urban Community Old-age Care Service Security

This article starts from the present situation of urban community old-age careservices, in the way that the elderly enjoy the legal rights about the elderly communitycare services, and aims to improve community old-age care services for legalprotection.The article is divided into two clues to discourse: one is to analyzetheoretically the connotative meaning and current situation of urban communityold-age care services, and point out the lack of institutionalization of its services. Theother one is to regard making community ole-age care services to the legal right as thecentral problem, analyze a number of legal issues in the field of urban communityole-age care services, and then offer comprehensive proposals about urbancommunity old-age care services protected by the legal system.There are six sections in this paper:Introduction describes the topic, the research background and significance.The first part: general principles of urban community old-age care services. Itintroduces the definition, legal relationship and theoretical foundation of the urbancommunity old-age care services, analyzes the necessity of urban community old-ageservices because of aging population and weakening of family supporting function.The part of the legal relationship analyzes the nature of pension rights including themeaning of enjoying the community old-age care services from the dimensions oflegal rights, social rights, human rights. Then it analyzes the legal issues involved incommunity old-age care services, and evaluate and analyze the laws and regulationsabout administrative permission of old-age care institutions, and legal disputesbetween the providers and the demanders involved in community old-age careservices. It elaborates equity and efficiency issues with protection of the governmentto protect citizens’ realization of old-age rights and industrialization of old-ageservices, and then discusses the objects to bear the responsibility in the urbancommunity old-age care services.The second part: current situation of urban community care services. It analyzesthe reasons that the community old-age care services are born in the United Kingdomand the history in our country, at last lists its current situation, existing problems andlegal dilemma in China. The third part: theoretical value of old-age services in urban community legalprotection. It states the theoretical basis of the legal protection of the urbancommunity old-age service.The fourth part: corrective actions of old-age services in urban community legalprotection. It points out the principles of community that the legal protection ofold-age care services should follow, on this basis, then responds to problems about theold-age services in urban communities mentioned in the second part, and puts forwardsome measures to improve legal protection of the urban community old-age careservices.Conclusion summarizes the results of this paper, points out the relevantinnovative ideas, states the content to deepen, and finally re-emphasizes the main ideaof the article.
