The Legal Regulation On Network Public Opinion Supervision Of Judicial Adjudication

In the current Internet Age, the internet public opinions have been becoming more and more significant both in scale and influence, which is a new form for the public to participate in the administration and discussion of state affairs. Judiciary is becoming more transparent and the public is more willing to take part in the discussion of judicial action, which makes the frequent occurrence of judicial internet public opinions events. Internet public opinions can supervise judicial adjudication. Therefore, in order to ensure smooth internet public opinions expression and to make sure a more open judiciary as well as to realize the fairness of judicial adjudication,we need to consider how to deal with the relationship between internet public opinions and judicial adjudication and how to response to internet public opinions actively. With regard to the respond to the cyber public voice, the court should not only focus on the analysis of the relation between those single cases and the good operation of the judicial adjudication, but should also adopt public opinions in a rational way to avoid the adverse effect of the public cyber supervision.This paper first discusses the basic theory of cyber supervision by public opinions, which mainly analyzing the reasons for which causes the conflict between the supervision and the judicial adjudication and the influence of the former on the later. The intervention and supervision of the Internet public opinions can prevent the weakness and corruption of judiciary.It also can promote the fairness and transparency of judicial adjudication, which serves as the positive value. But the emotional and provocative Internet consensus can result in non-rationality of judicial adjudication and violate the independence of it, which is the negative influence. From both positive and negative influences, a reflection is made on the reasons arousing conflicts, we can find out the appropriate strategies from the existing problems of the supervision on internet public opinions and abroad to build internet public opinions guidance and carding mechanism.Meanwhile, we have to strengthen the construction and improvement of the network laws and regulations to regulate internet public opinions supervision by law.
