On the impact of economy, civil servants began to leave their offices on the 1990 s. We can understand their leave and choices to various jobs. To some extent, this reasonable and legal demission helps government lay off redundant staff and streamline govern-ment organs, cooling down the crazy for public position now. In fact, we also notice that in the process of finding new jobs, many civil servants who left offices still use powers they got when worked for government to fly their own kites. In this paper, based on this selected topic background, through to the civil servants after leaving the relevant contents of” residual power” defining the connotation and types, we analyzes the present situation of the civil servants ” residual power” after departure. The paper analyzes the present situation of the constraint about the civil servant ” residual power” after departure, which is from the legal level,mechanism level and moral constraint level, combining with the analysis of draw lessons from foreign advanced experience and can conclude some paths and suggestions of C hinese national conditions.
