Research On The Subjuct Of Administrative Accountability In The Perspective Of Administrative Self-Restraint

Since the event of "SARS" in 2003, the administrative accountability has gradually become an imperative measure taken by China’s government to govern officials and in response to public opinion, and it has gradually standardized and institutionalized.Administrative accountability plays an important role in promoting the construction of responsible government and the government ruled by law, and provides "to Put power into a cage of the system "with an critical guarantee.However, the practice of administrative accountability in our country shows a certain confusion for the lack of a unified legislative norms.Academia not only has differences in understanding of the administrative accountability, but also cannot agree on the concept of administrative accountability.Due to the differences of basic concepts in theoretical research, theory for the support of the system is is slightly weak.Therefore, the administrative accountability needs new theoretical perspectives and analytical tools, and the administrative self-restraint theory may be an important attempt.The administrative accountability system includes many elements, and the administrative accountability subject is its core component.The studies of administrative accountability subject is of vital importance for either the unity of the concept of administrative accountability, or the improvement of administrative accountability system.This paper studies the administrative accountability from perspective of administrative self-restraint,based on the development path of the administrative accountability system in China, which can distinguish the administrative accountability system and other accountability mechanisms, and ultimately determine the scope of administrative accountability.Based on the delineation of the scope of administrative accountability,this paper reflects on research status of traditional administrative accountability subject, and puts forward the division of initiating subject of administrative accountability and the implementing subject of administrative accountability, and further classifies the initiating subject of administrative accountability as the initiating subject of state organ and the initiating subject of non state organ.According to the different characteristics of the three kinds of subject,this paper comes up with a research method to regulate the initiating subject of administrative accountability of the state organ,protect and motivate the the initiating subject of administrative accountability of the non state organ,and regulate the implementing subject of administrative accountability.Under the guidance of this thought,this paper examines the deficiency of the existing administrative accountability system in our country, and finally proposed related suggestions.
