Reserch On Administrative Accountability By Outside Bodies System

Since the outbreak of SARS in 2003,China's administrative accountability system has developed rapidly. Administrative accountability, as an important way for construction of responsible government, is of great significance to the progress of socialist democracy. According to different subjects of accountability, the accountability system can be divided into single-subject accountability and allogeneic accountability. Compared with the single-subject accountability, allogeneic accountability will comply with the requirements of the development of socialist democracy, with greater effectiveness and credibility. Currently, however, most of administrative accountability in our country is single-subject accountability, and allogeneic accountability is in an "absence" state, the subject of accountability such as the people's congress, the judicial authorities and the public etc.don't come into full play. And the theoretical research on the allogeneic accountability is also lack of dedicated and systematic exposition.Therefore, the study on this subject is with a positive practical and theoretical significance.The Third Session of the Eleventh National People's Congress NPC in 2010 sent the instructions to strengthen supervision, indicated that it will carry out inquiry and enquiry on""a government, the Court and the Procuratorate"and relevant government agencies according to the law in the future, and Premier Wen Jiabao's government work report in 2010 also proposed to create conditions for people to criticism and supervise, which creates a good environment for the development of administrative accountability system.This thesis includes five parts.Chapter one is an introduction, which describes the research background, purpose and significance, research method and framework for this thesis.Chapter Two discusses the concepts,fea tures and significance of allogeneic accountability,as well as popular sovereignty theory, public choice theory, theory of good governance,and other fundamental theories which have laid a foundation for the following study. Chapter three, the focus of this thesis, analyzes the position, current status, and existing problems of allogeneic accountability of the NPC,the judicial authorities, the CPPCC, the media and the public. Of which, NPC is the most authoritative body, judicial authorities and CPPCC are the important body, media is influential rapidly and powerful subject and the public is the most fundamental body, and it also points out that the subject of accountability has degrees of vacancy and thoroughly studies on the reason for its incomplete effectiveness.Chapter four introduces the allogeneic accountability system of the UK, France, the United States, as the representative of the Western developed countries, in order to identify the experience for the allogeneic accountability system in our country. On the basis of diagnosis of the problem and analysis of its reasons, chapter five concludes and puts forward the specific proposals to improve out allogeneic accountability:to improve legislation and legal systems for allogeneic accountability;cultivate a healthy culture of allogeneic accountability;perfect the relevant supporting systems;appropriately refer to the experience of western allogeneic accountability etc.
