Research On The Direct Election Of “Village Officials”

“The Village Committee Organization Law” was officially announced in November 1998 and revised in October 2010, which endowed with the rights of rural residents direct election of villagers committee chairman, vice chairman and members. The formal implementation of the law is a major symbol of the realization of socialist democracy in China. It is a breakthrough in the protection of people’s democratic rights, and it is of great reference and experimental value for the reform of China’s democratic political system. However, the implementation of the law of 17 years, villagers committee election system in the operation process produced a series of problems, such as bribery serious, election and lack of supervision, and election irregularities legal responsibility is not clear and so on, and seriously affected the fair elections, democratic and legitimate.During December 2013 and May 2014, I worked in LuoGang District of Guangzhou City "Villages" election working group, participated in the supervision of the election of the election, illegal acts, and specifically in charge of the supervision work of W village and YT village.In nearly half of year, I contacted the large number of candidates and voters, and participate in the identified the two villages of the bribery case. The main reasons to the problems of villagers committee election are : 1, candidates and voters are lack of democracy consciousness; 2, the huge economic interests influenced the villagers committee election deeply; 3, illegal behavior cannot be investigated, and costs low;4,the absence of monitoring in the election process,and it’s difficult to restrain illegal persons; 5, the power between the village Party branch and village committee decentralization is not clear. For greater powers, Party branch election and villager committee election irregularities exists incremental effect.In legal perspective, I suggestions to improve the village committee election system in such ways: 1, the act of destroying the election of the villagers committee into the punishment of the criminal law; 2, improve the legal awareness of the village cadres and villagers; 3, to transfer the collective financial autonomy to the government through legislation, to supervise in advance and work, reduce the illegal economic interests appeal to candidates; 4, to define the powers and responsibilities of the party organization and the villagers committee through normative documents, in order to reduce the vicious competition between the two candidates in the election; 5, in the form of law, formulate normative legal documents to the village with supervision in the election, make supervision work more maneuverability.This paper is divided into five parts: The first part is the introduction, which mainly introduces the research background, significance, current situation, research ideas and methods and possible innovations and shortcomings. The second part is the implementation of the organization and procedure of the election. The third part: all sorts of problems arising in the election. The fourth part: analysis of the reasons for the current election of the village committee.The fifth part:according to the results of theoretical research, law and the author’s work experience, to give advice and suggestions for the election of village committee.
