Research On Legal Issues About Reduction Of Greenhouse Gas Emissions From International Shipping

Reduction of greenhouse gas emissions from international shipping is a part of global reduction of greenhouse gas emissions,which is aimed at regulating the greenhouse gas from ships engaged in international voyages.Compared with the reduction activities of other fields,reduction of greenhouse gas emissions from international shipping arose late,which resulted in many controversies and problems.Thus,this thesis is divided into five parts to approach the problem.The first chapter introduces the relationship between reduction of greenhouse gas emissions from international shipping and climate change,analyzes the particularity of reduction of greenhouse gas emissions from international shipping and discusses the standpoint and future trend of international community on reduction of greenhouse gas emissions from international shipping according to current legislative practice.The second chapter researches the applicable principles of reduction of greenhouse gas emissions from international shipping,discusses disputes on applicable principles and combines the discussion with the requirements of international environmental justice to draw a conclusion that Common but Differentiated Responsibility Principle is the most suitable principle on reduction of greenhouse gas emissions from international shipping.The third chapter analyzes ship energy efficiency measures,discusses its functions and limitations on reduction of greenhouse gas emissions from international shipping and accordingly suggests some legal solutions on it.The fourth chapter discusses market-based measures,mainly analyzes International Fund for Greenhouse Gas Emissions from Ships and Global Emissions Trading System for International Shipping which are the two major forms and expounds their functions and limitations on reduction of greenhouse gas emissions from international shipping.Then it combines with the requirements of Common but Differentiated Responsibility Principle and suggests that the most suitable market-based measure for international shipping is an add-on Rebate Mechanism built into Emission Trading System.The fifth chapter analyzes the impact of international legislation about reduction of greenhouse gas emissions from international shipping on our country,mainly discusses our country's lack of competence to meet those legislative requirements and respectively puts forward some suggestions on domestic and international level.
