A Study On The Legal Guarantee Of Grassroots Democracy In Rural Areas

The system of people's congresses,the multi-party cooperation and political consultation system under the Communist Party of China,the system of regional ethnic autonomy and the system of self-government at the grassroots level constitute the core content and basic framework of our political system and the concentrated expression of socialist democratic politics.After the reform and opening up,with the development of China's democratic political construction,grass-roots mass autonomy system gradually established.This system is an organic part of China's basic political system.It is an important content of China's socialist democratic politics.It is the exercise of democratic rights by the people according to law,the management of public affairs and public welfare at the grassroots level,self-management,self-service,self-To achieve the people the masters of the most effective and most extensive way.The grassroots autonomy system including rural villagers' autonomy and urban community residents autonomy.For the ruling party,the grass-roots organization construction is the party's work center of gravity,basis.In order to build a new socialist countryside and the realization of the dream of China,must want to perfect the construction of rural grassroots organizations,strengthening the rural grass-roots party organization's creativity,cohesion and combat effectiveness,to promote the new rural construction to provide strong organization guarantee.As an agricultural country,rural development is the foundation of China's economic and social development.Only to farmers,agriculture and rural these three questions deal with to make our country's political,economic,cultural,social,and ecological civilization construction.Since reform and opening up,the quest for the rural construction has been in constant reform,nearly 10 years in our country in new rural construction has made considerable achievements,however,the rural grassroots democracy rule of law construction is less involved.Rural democratic rule of law should be as part of the new rural construction strive to achieve.Current exist certain obstacles in the construction of rural grassroots democracy,rule of law,improve and perfect the legal system is the precondition of the realization of rule by law in countryside democracy at the grassroots level,to say the democracy and the implementation process of the rule of law is the process of democracy and legal system and improve and perfect.At present our country related laws are mainly the villagers committees of the People's Republic of China,and rural grassroots democracy rule of law is still lacking of related law,no specific legal norms as a guide,rural grassroots democracy will be difficult to realize the rule of law construction.The main body of rural grassroots democracy,rule of law construction in China mainly includes the basic level of villages and towns government and village party branch,village committee and villagers.In the rural democratic autonomy,democracy is the villagers to manage in accordance with the principle of equality and the minority is subordinate to the majority of village affairs.In this paper,by analyzing the development and present situation of the rule of law in our country countryside democracy at the grassroots level,including the achievements and the deficiencies and causes,it can be seen that China's current rural democratic rule of law is made great achievements since the reform and opening up,but still contradiction problem is very outstanding,the main can be summarized as lack of consciousness of rule of law,democracy and legal system is not perfect and democracy at the grassroots level autonomy mechanism is not sound and so on.We should attach importance to the rural democratic rule of law construction in the new rural construction of important strategic significance,aiming at the problems in practice,this paper puts forward some Suggestions,including straighten out the relationship between the government and the village at the grass-roots level,to coordinate the relationship between the village party branch and village committee,to strengthen the construction of rural grassroots democratic legal system,promote the rule of law consciousness of the masses in rural areas,to achieve the government's effective supervision of village committee democratic autonomy work.
