The Study Of Marxist Legal Thought And Confucianism Thought

In 2014,the decision of the Central Committee of the Communist Party of China(CPC)to comprehensively promote a number of major issues in governing the country in accordance with the law of the Fourth Session of the Eighth Central Committee of the Communist Party of China(CPC)stressed that it is necessary to carry forward the spirit of socialist rule of law and build a culture of socialist rule of law,at the same time uphold and develop Marxist law and learn from the essence of Chinese legal culture,in order to realize the goal of building a socialist country under the rule of law with Chinese characteristics,which point out the direction for study on the integration of Marxist legal thought called as the origin of legal system of socialism with Chinese characteristics theory and Confucian law thought as the core and soul of Chinese legal system.Adhering to cultural self-confidence in the construction of the rule of law is that adhering to Marxist legal thought as a guide for the innovative development and creative transformation of Confucian law thought,which make Marxist legal thought and Confucian law thought really realize integration and serve the construction of Chinese characteristic socialism country under the rule of law the overall goal.The thesis focuses on the study of the integration of Marxist legal thought and Confucian law thought,which mainly consists of the following three parts:Chapter 1: The necessity of the integration of Marxist legal thought and Confucian law thought.The great achievements of the construction of socialism with Chinese characteristics are inseparable from adhering to the “four self-confidence”,especially cultural confidence.The construction of the rule of law can be so effectively,as well as because of the “four self-confidence”,especially the confidence in culture of the rule of law.Marxist legal thought is the guiding ideology of the cultural confidence of the rule of law and carrying forward the excellent Chinese traditional legal culture is the inevitable requirement of the cultural confidence of the rule of law.In the exploring of the road of socialist rule of law with Chinese characteristics,with the changes of national macro management in country,the improvement of the top-level structure of the rule of law in country and the insistence of the value orientation of law in the country,it is urgently necessary for the integration of Marxist legal thought and Confucian law thought in the construction of Chinese characteristic socialism country under the rule of law theory level.Chapter 2: The feasibility of the integration of Marxist legal thought and Confucian law thought.The integration of Marxist legal thought and Confucian law thought is based on the target of the construction of Chinese characteristic socialism country under the rule of law andthe architecture of realizing “five in one” strategy.With the progress of the integration,Marxist legal thought has been enriched and developed,and at the same time,Confucian law thought has been promoted and got modern evolution under the guidance of advanced Marxist legal theory,which conform to the spirit pursuit under the construction of legal civilization with Chinese characteristics.Chapter 3: The principles and dimensions of the integration of Marxist legal thought and Confucian law thought.The integration of Marxist legal thought and Confucian law thought are inseparable from the mechanism of communication on the basis of criticism.It must be systematic for the requirement of criticism,which ensures that the theory is universal.Critical weapons can't replace the criticism of weapons.It must be adhered to the principles of the systematic criticism and reasonable application for the whole of the ideological theory,and the principle of limiting the context,strict application for the application of specific content.Based on these principles,the thesis studies the integration mechanism from the following four dimensions: “scientific legislation”,“strict law enforcement”,“fair justice” and “comprehensive law-abiding”.
