In recent years,the Party Central Committee and the State Council have continued to pay attention to the issue of agriculture,rural areas and farmers and have made major strategic deployments to China's rural financial reforms many times,which has played a crucial role in accelerating rural economic development.Mortgage loans for land contracted management rights,as an innovation in the process of rural financial reform,have completely changed the situation in which the resources of peasants cannot be converted into floating assets for a long time.This has effectively invigorated rural resources and eased the problem of farmers' financing difficulties.Speed up the process of agricultural modernization.Gansu Province,as one of the underdeveloped areas in the northwest,will undoubtedly have an important role in promoting the development of Gansu's rural economy.Gansu Province has made remarkable achievements since it launched the mortgage loan business with land contracted management rights,but with the rapid development of this business in various pilot areas,it has gradually exposed many potential risks.Based on the study of domestic and foreign related research,this article analyzes the development status and achievements of the business in Gansu Province from the perspective of the bank,and discovers the existing problems.Based on this,it examines the risks from credit risk and collateral.Analyze the risks that the bank may face in carrying out this business from the angle of legal policy,and then conduct a game analysis on the behaviors of the two main entities involved in mortgage loans for land contracted management right and the three main entities involved in the introduction of guarantee institutions.According to the analysis,the loan amount and interest rate are proportional to the probability of the farmer's breach of contract.The assessed value of the land contracting operation right and the total cost of the bank loan are inversely proportional to the probability of the farmer's breach of contract;the introduction of the guarantee institution to participate in the land contractual management right mortgage loan can be From the perspective of reducing the possibility of breach of contract and reducing losses from breach of contract,banks can help prevent the risks of the business.Finally,suggestions on risk prevention are provided from the perspectives of the government and pre-lending,lending,and lending perspectives of banks to provide reference for the development of this rural Gansu business.
