This translation report is based on the translation practice of “Factors Shaping the Character of the Judiciary”,Chapter 7 of Judiciaries within Europe: A Comparative Review.This book is a legal treatise written by American legal scientist John Bell on the careers and roles of judges in France,Germany,Spain,Sweden and the United Kingdom.Chapter 7 summarizes the factors which shape the character of the judiciary of the above five countries.This translation report describes the translation process,analyzes the linguistic features of the source text and elaborates on the two typical problems encountered in the translation practice and their solutions.One of the typical problems is the translation of technical terms,particularly for the common words with legal meaning,the technical terms involving lexical gap,recurring technical terms and borrowed technical terms.Solutions to the translation of each of the types of the technical terms are discussed in detail.The other typical problem is the translation of passive sentences.Solutions to the translation of them are also presented in detail.The purpose of this translation report is to summarize the translation practice and to propose strategies and skills to deal with the typical problems in the translation of legal treatises.
