An Empirical Study Of Case Management System In The Implementation Of Community Corrections

Facing the contradiction between the growing community corrections number and the unreasonable establishment of management institutions and management work is not uniform,nor standardized.The community correction case management needs to be reformed.Make full use of the advantages of the case management system,to resolve the current situation of non-standard community correction case management,"management" and "execution" regardless of the situation and to promote the continuous improvement of the community correction case management system.This article starts with two aspects of theory and practice,to comprehensively analyze the current situation with the results of interviews between the C City Municipal Bureau of Justice and the community corrections staff of the L District C City Judicial Institute.Comprehensive analysis of current institutional norms,case management models,and management functions in the implementation of community corrections in China.The text of this article is divided into four parts:The first part discusses the development course and investigation present situation of case management in the implementation of community corrections in China.Firstly,introduce the process of community correction in our country.It is mainly divided into four development stages: blank stage,budding pilot stage,comprehensive trial stage,and formal establishment stage.Secondly,the management of community correction cases in China is still at an experimental stage,lacking systematic regulations and comprehensive practical exploration.The second part discusses the current situation of decentralized management in the implementation of community corrections in China.The case management mode in the implementation of community corrections in China is mainly based on decentralized management.According to the different stages of management can be divided into the decentralized management mode of community correction,a decentralized management mode and judicial cases Management Bureau of justice.The third part discusses the issue of case management in the implementation of community corrections in China.In view of the situation in the previous section,the issues arising from the case management system were summarized: First,the legal system of case management is not perfect,and there are neither judicial interpretations nor specific rules and regulations for the case management of community corrections.It is almost in a condition of “cannot be trusted”.Secondly,the case management method is not standardized.Under the decentralized management model,the grassroots case management pressure is increased,the “management” and “execution” are not separated,the case management standards are not uniform,and the degree of informatization needs to be improved.Finally,community correction case management and case execution alternated,resulting in non-proprietary management functions,confusion of internal functions and functions,and low management efficiency.The fourth part discusses the assumptions of case management in the implementation of community corrections.Based on the findings of the previous research and data analysis,several ideas were proposed on the reform of the community rectification case management system in order to provide reform ideas for the case management system of community rectification: Firstly,to speed up the management system Legal construction,guarantee the standardization of case management.Secondly,to strengthen the unification of management institutions,on the one hand to promote the external independence of the management organization,establish a unified set of standards,on the other hand,to set up a case management center within the management organization,to achieve special management;Thirdly,it promotes the informatization of case management and establishes a community correction implementation information center.The case management process realizes network management and establishes an information exchange system.Finally,the case management quality assessment system should be established to standardize case management procedures and ensure the management,supervision and service functions of case management.
