Research On The Construction Of Supervisory Power

The reform of supervisory system is the most profound and important political system reform in our country at present.The aim is to establish a powerful and high-status supervisory committee to exercise the reintegrated state supervisory power,to strengthen the anti-corruption achievements since the 18 th CPC National Congress and to establish the path of future institutional anti-corruption.After more than a year of reform,the legal system of supervisory power has been basically completed.Reflecting on the vigorous conduct of the past year,we should realize that there is still more to be explored and more work to be done to establish a complete legal system and a well-founded national supervisory power.This paper reviews the whole process of the reform of the supervisory system,expounds the necessity and significance of establishing the state supervisory power,and analyses the constitutionality defects and the anti-corruption efficiency defects of the past discipline inspection and supervision anti-corruption mode.Then the article starts from the pilot stage of whole reform,explains the existing legal basis did not sufficient,the application of the law was not appropriate and the legal system was not perfect.We will face similar constitutional reform in the future,so the clarification of key points above is very vital.After that,this paper summarizes the problems that have been exposed in the pilot work.This paper systematically analyzes the four aspects of supervision power legislation,the independence of the power,the restriction of the power and the diversification of the mode,and explores the existing problems from the angle of constitutional jurisprudence as far as possible.Finally,aiming at the problems raised,this paper tries to put forward some tentative ideas and prospects for the legislative perfection of supervisory power.On the one hand,we should perfect the supervisory legal system centered on the state supervisory power.On the other hand,we should provide some ideas for other possible constitutional reforms in the future,and construct a mature model of constitutional reform.
