Study On The People's Congress Of External Accountability

After 18 th CPC National Congress,China has made great progress in promoting the law-based administration and building a government ruled by law,we also made a lot of achievements especially in the construction of administrative accountability.But we should also note the shortcomings and defects on the way to promote the law-based administration and the construction of government ruled by law.We should pay more attention to build administrative accountability system which as an important way to establish a responsible government and a government ruled by law.Predictably,the administrative accountability not only be the highlight of China's legal reform,but also a great mountain we must overcome to build the goverment of law.Therefore,we must resolutely promote the construction and improvement of the administrative accountability system.Administrative accountability is divided into internal accountability and external accountability.Internal accountability is a administrative system accountability,and external accountability is the administrative system which let outside forces execute accountability,such as the National People's Congress,Party committee,social groups.External accountability has the same importance as the internal accountability.As the main part of administrative accountability,the internal accountability system reflects the efficiency of accountability and the principle of efficiency in the legal value.But the administrative organization authorities themselves to manage their own affairs,a phenomenon reminiscent of a legal proverb: "Be your own referee".Obviously,this is can not guarantee of fairness and justice,which of course cannot reflect of fair value and the value in the legal value system.External accountability has the same importance with the internal accountability by any means,in the process of building a government under the rule of law,we can not only pays attention to accountability,but also put external accountability,especially the National People's Congress accountability,to a more important position,which can make the construction our external accountability keep upwith the pace of the construction of the government under the rule of law.There are a lot of literature about the National People's Congress on external accountability research,but the article from the perspective of the NPC to think about how to improve our external accountability system are very few.Author make a further study on the meaning of theory and Practice about this issue is to promote the establishment and perfection of administrative accountability system and accountability theory.The research method of this paper including comparative research method and empirical analysis method.This paper is divided into six parts:? This part mainly expound China's current administrative accountability background,analysis the necessity and urgency of the National People's Congress external accountability.? This part discriminates and defines some basic concepts of administrative accountability?administrative external accountability?external accountability of the NPC,and then explains the theoretical basis of the NPC's external accountability.? This part analyzes the present situation of our country's people's Congress' s external accountability system,including the present situation of the NPC's external accountability.? A comparative study of United Kingdom?the United States?france in allogeneic accountability system,and summarizing the experience.Then the analysis of western mature allogeneic accountability system enlightenment to us.? Put forward the recommendations on construction of China's National People's Congress external accountability system.? Conclusion.
