Study On Legal Prevention And Control Of Safety Risk In Operation Of Net-appointed Vehicles

Under the background of "Internet +" era and with the development of mobile Internet technology and traditional industries,Internet related vehicle as a new industry of "Internet + transportation" has brought out great economic and social value.The online car-booking platform directly connects consumers and online car-booking passenger service providers,which meets the diversified and personalized traveling needs of consumers,and changes the traditional way of travel and passenger service.In recent years,with the continuous development of the network car industry,the security problems of network cars once again brought the industry to the focus of the public.How to take measures to prevent network car safety problems has become a big issue to be solved for both governmental supervision department and online car-booking platform.This paper is divided into three chapters to study the legal prevention and control of the online car-booking safety risk in China.The first chapter mainly discussed the specific manifestations of the safety risk of online car-booking separately,to understand the risks existing in the online car-booking industry,and to show the safety risk of online car-booking through real cases,so as to illustrate the lack of legal prevention and control of the online car-booking safety risk in China at this stage.The second chapter discussed and analyzed the problems existing in the legal prevention and control of the online car-booking safety risk,as well as the causes from four aspects,including the imperfect legal standards,the lack of protection mechanisms,the imperfect supervision mechanism,and the responsibility mechanism.The third chapter put forward some reasonable suggestion for the legal prevention and control of the online car-booking safety risk.In view of the problems existing in the legal prevention and control of network car safety risks,beneficial experience of foreign countries should be learned,combining with China’s national conditions,to improve the legal standards of network vehicles,to build up a car-related main body protection mechanism,a sound network car platform supervision mechanism and an overall online car-booking industry responsibility mechanism,according to which certain reasonable suggestion should be put forward to provide ideas for solving the problems in the legal prevention and control of online car-booking operation safety.This paper,from a unique perspective of researching the online car-booking safety risk,The effective implementation will standardize the order of the network car market,improve relevant laws and regulations system of the network cars,so that China’s online car-booking industry can maintain a healthy development trend in the future market.
