Building regulatory government has become a global wave of government change.China is now gradually building regulatory state based on the the principles of the rule of law,profession,and independence,and our country has made considerable progress in decades.However,the current market regulation system is not yet completely mature.Recently,the rapid development of the sharing economy has become a strong driving force for China's economic development.On the one hand,through the application of the Internet technology,Internet platforms help users achieve precise peer-to-peer interconnection,which improve resource allocation efficiency.On the other hand,the sharing economy has the characteristics of cross-regional,cross-industry,wide participation and high degree of uncertainty,which bring certain impacts on China's existing regulatory systemAmong various modes of the sharing economy,the development of the online car-hailing industry is highly representative,from the perspectives of development time span,the degree of attention and the governments' regulatory behaviors.This article takes online car-hailing industry as a case,and then examine the development history of the online car-hailing industry and its corresponding government regulation behaviors.Based on the public interest theory and the investigation of the development of government regulatory practice in various countries,the article argues that the basic mission of government regulation is to enhance and support the function of the market by setting and implementing market rules fairly and impartially based on the rule of law,in order to overcome the possible market failures.Specifically,its objectives can be divided into two aspects:on the one hand,the government is supposed to maintain a fair market order,define clear property rights,and promote fair competition among market participants.On the other hand,it is also required to maintain social security and health,and protect the legal rights and interests of the participating entities in the market.Whether in the new format or the old format,the basic mission will not change However,from the actual level,by examining practice of government supervision in the online car-hailing industry,the article believes that the current government supervision shows some kind of behavioral characteristics,which means lack of supervision in the early stage and excessive supervision in the later stage.And such problems are not an individual case,which means they are also ubiquitous in other areas of sharing economy,even in the traditional economy.Then,the article argues the reasons behind the problems is China's existing regulatory model that has not yet fully modernized.At the subjective level of supervision,the existing regulatory model presents the "no accident government logic"of the regulatory authority,which if the public has no complaints,the government would have little trials.While at the level of objective supervisory ability,the existing model presents a fragmented pattern of internal government cooperation mechanisms in terms of regulatory authority,also incentive and information means are not sufficiently applied in the existing model.In all,the government lacks the ability of normal,active and effective regulation towards the new format,which shows the limitations of hysteresis,passive,irrational and non-institutionalFacing the future,the article based on the basic role that the government should play in the regulatory state,the government should actively respond to the rules,respond to the mission.At the same time,based on the characteristics of the Internet platform under the shared economy,and relevant theories of responsive regulation,the article believes that the government should emphasize timely response in regulatory values,effective coordination of internal and external aspects in the regulation bodies,the introduction of diversified methods in the regulation tools,and also improvement of relevant norms in the regulation system.
