The Limits Of Citizens' Right Of Expression And The Principle Of Judicial Governance

With the awakening of civil rights consciousness,the citizen's right of expression as the basis of citizen's participation in social life,how to guarantee the citizen's right of expression is an age proposition that can not be ignored.Our Constitution expresss the right of citizens to express their rights,that is,they have freedom of speech,publication,assembly,association,procession and demonstration.However,in real life,the citizen's right of expression is always due to the vague boundary of rights,the arbitrary form of public power,the failure of judicial governance mechanism and other reasons,it is difficult to function normally,improve the civil rights expression mechanism,ensure the realization of citizens' right to express,and construct the judicial governance path of citizens' right of expression is an effective way to realize the right of citizen's expression.This paper takes the 2018 "Hong Mao Drug Wine Case" as the starting point,through the analysis of the three points of contention in the case,namely,whether the compulsory measures of the Liangcheng County Public Security Bureau constitute a violation of the right of expression of citizens,whether The Hong Mao pharmaceutical and liquor advertisement is a false advertisement,and whether Tan Qindong constitutes a crime of damaging business reputation and commodity reputation,and provide practical experience for the realization and protection of the right of expression of citizens.The life of the Constitution lies in its implementation,and the realization of the citizen's right of expression is an important embodiment of the living vitality of the Constitution.Based on the citizen's right of expression,using the research methods of literature analysis,case analysis and comparative research,this paper provides a theoretical basis for better protecting the citizen's right of expression by analyzing the above-mentioned controversy focus of the "Hong Mao Drug wine case" and drawing corresponding conclusions,combining the boundary of citizens' right to express,the response of judicial governance and the examination of specific cases.General Secretary Xi Jinping stressed that putting power in the cage of the system allows the power of state public officials to operate in the sun.The socialist icing society with Chinese characteristics is the rule of law,the rule of rule and the rule of procedure,and the effective operation of ensuring the right of citizens' expression is not only the cornerstone of the guarantee of civil rights,but also an important link in the full implementation of the Constitution.
