Legal Regulation On The Protection Of Victims’ Rights And Interests In Campus Bullying

Campus bullying has long existed in primary and secondary school campuses.In recent years,the consequences of bullying incidents on the Internet have become increasingly serious.Due to the particularity of the main body of bullying behavior on campus,the punishment for bullies is insufficient,and the handling of bullying incidents is also lost.This article believes that in the face of campus bullying incidents,we must not only punish bullies,but also protect the rights and interests of victims in a fair and reasonable manner from the perspective of the legal system,judicial practice,and school protection.This article summarizes the characteristics of bullying behavior on the basis of the concept of campus bullying in primary and secondary schools,and then explains the difference between campus bullying and campus violence.Based on the analysis of the type of victim’s infringement and the current status of victim protection,it is concluded that there are three main problems in the protection of victim’s rights and interests: first,in terms of legal system,the victim is unable to rely on after being bullied by the campus,and The level of the normative documents on which it is based is relatively low,which has no effect of protecting the rights and interests of victims.Second,in terms of judicial practice,judicial staff have insufficient protection of the rights and interests of victims,resulting in secondary injuries to the victims.Thirdly,in terms of school protection,as the first person in charge,the education,management,and protection work are not in place,and the scope of the school’s responsibility is not clear.By summarizing the legal protection experience of British and American countries for the victims of campus bullying,starting from the current situation in my country,we propose measures to protect the rights and interests of victims of campus bullying.Improve relevant laws,define bullying on campus,and allow victims to have a legal basis;pay attention to the special protection of victims’ judicial practice,expand the scope of legal aid,and establish a systematic psychological diagnosis and treatment recovery mechanism.Strengthen school management,establish a campus bullying prevention mechanism,and clarify the scope of school responsibility.
