Research On Quality Evaluation Of Biomedical Patents Based On Colleges And Universities Patent Transformation

Objective:To build a patent quality assessment system and a patent quality evaluation model of biological patents based on the data of universities patent transformation.To find the factors affecting the patent quality of colleges and universities through the empirical research.To provide the basis for colleges and universities patent quality management.To identify the colleges and universities in Sichuan province with advantages of biomedical innovation and to select high quality patents.Methods:(1)Use literature research method to analyse domestic and foreign patent quality evaluation theory and research status.(2)Use empirical analysis method to test the model based on the data of domestic colledges and universities biomedical patent transformation.(3)Use case analysis method to compare and analyze the patent quality of different annual,applicants,technical fields of colledges and universities in Sichuan province to figure out the factors affecting the patent quality.Results:(1)At present,the research on patent quality evaluation has developed from theoretical research to empirical and applied research.Research contents include the definition of patent quality,the research of the patent quality index system,the research of patent quality assessment,the research on the influence factors of patent quality and the research on the countermeasures of patent quality improvement.(2)Cited frequency,patent family,number of claims and document pages are positive related to the quality of biomedical patent,regression coefficient was respectively 1.995,0.389,0.065,0.020 and 0.880.The number of first claim words is negative related to the quality of biomedical patent,and the index regression coefficient is 0.001.(3)As of December 31,2017,the number of patent applications in the biomedical field of colleges and universities in Sichuan province is 1119,and the average patent quality has not fluctuated significantly in the last ten years.In terms of average patent quality index,Sichuan University and Chengdu University of Traditional Chinese Medicine are among the top universities in the province.The patent quality in the field of chemical medicine is the highest,and the field of biological medicine is the second.(4)Through the analysis of the quality assessment of biomedical patents in universities in Sichuan province,it is found that there is a positive correlation between patent quantity and patent quality.The cooperation of industry-university-research cooperation and scientific research team is conducive to improving the quality of patent technology in universities.The establishment of the incentive mechanism of scientific and technological achievements in colleges and universities contributes to the output of high-quality patents.It is helpful for the patent agency to write patent application documents to improve the legal quality of patent.Conclusion:(1)Cited frequency,patent family,number of claims and document pages are positive related to the quality of biomedical patent,the number of first claim words is negative related to the quality of biomedical patent.(2)Over the past ten years,the number of patent applications in the biomedical field in universities and colleges in Sichuan province has increased sharply,but the patent quality need to improve,especially in the technical field of traditional Chinese medicine.(3)The influencing factors of patent quality in universities include the number of patents,the level of scientific research team,the way of scientific research cooperation,the patent application motivation and the quality of patent agency.(4)It is suggest that colleges and universities take advantages of key disciplines,integrate scientific research resources,establish scientific research teams,establish and improve the performance evaluation mechanism to promote the transformation of patents,and strengthen the control over the quality of patent agents.
