The Evaluatiom Of Universities Patent Quality And Countermeasures Research In The View Of Market Incentives

For a long time,patents in China's university showed a phenomenon of high application but low efficiency.The patent protection from the date of authorization was two to three years,which is far less than 20 years contemplated by patent law.The short life of patent proved that most patents have little economic value and cause the waste of resources.The strategy of making development by innovation was proposed in the Eighteenth National Congress.The college is integral part of the innovation system,which undertook the mission of the scientific discovery and technological innovation.There were a large number of patents in college.However,the patent can create great value only when it was transformed.On the basis of above such background,the article thoroughly researched on the quality evaluation of university patent combined with the mechanisms of patent system from the market incentives in order to find out the development of university patent.The research of this paper would provide the university basis and reference to optimize resource distribution,improve the quality of R&D and standardize scientific research management.First of all,the university patent quality was defined as what conforms to China's Patent Law with high degree of technical innovations,high maturation,close correlation of market and stability of property in the article,according to the patent system theory and market valuation theory,working principle of patent system and the characteristics of patent in China which is low level patent censor system,huge number of university patent,high technical content,low technical maturity,low close correlation of market and cluster.Based on the confirmation of patent quality,the article researched the content of existing patent quality indicator,the evaluation index filtration and the assigning weight study by questionnaire,Partial correlation analysis and expert opinions.Then,the evaluation index of university patent quality was defined as number of items for claim,range of technologies,number of inventors,number of applicants,paten efficient,patent maintenance time,patent family and implementation rate.A new index was defined as the patent dominance which was quantified and reflected patent market value objectively,according to the fact deduced from type cost-benefit theory that patent maintenance time was positively related to the patent quality but influenced by its field of technology.The standard system of patent quality evaluation was built to take the market as the center and balance the feature of university patent.A model of university patent quality evaluation was set up by the comprehensive evaluation method combining qualitative and quantitative analysis.Secondly,patent analysis needed a lot of data.In order to efficiently resolve that patent analysis is difficult to get data,this paper studied and developed the collecting patent information system based on Hidden Web data mining.By distributed architecture,adopting technologies such as PHP?Memcache?Gearman?Mysql?ThinkPHP?the consistent as Hash arithmetic and associated with web automatic identification,a batch production of patent information including legal status was acquired effectively,quickly and economic.The capture system provided a good data base for the accuracy and objectivity of patent analysis.Thirdly,by means of the 985 university invention patent(including application)as experimental dataset,this paper analyzed the university patent quality by the comprehensive evaluation and rank according to the related indexes.The study found that universities in China have some advantages such as upgrade the capability of innovation,huge number of university patent,abundant technique research and development,but the university patents had so short life that most of them had not played the substantive role in economic activity.Therefore,the patent quality was poor based on market incentive benefits.Finally,the article studied the existing problem of patent quality in universities and put forward corresponding countermeasure from four aspects:adjusting policies of subsidized paten,improving patent awareness,promoting cooperation between university and companies and optimizing patent management mechanism.
