On The Right Of Peasant Collective Land After The Reform And Opening Up

Land as the most basic means of production in agriculture,is connected to economic society development,which is close to the life of ninety million peasants.Since the reform and opening up,China has implemented the rural household contract responsibility system for about forty years,during which the property right of peasant collective land has been changing all the time,and eventually it presents the present property rights form and some prominent problems.Taking Nan Hulin,a country village in Hebei Province for an example,I will make a thorough inquiry in its property right of peasant collective land.To research and analyze its history,reality,problems,and the effect on economy,the prominent problems could be solved and the reform measures could have demonstration effect.Nowadays,it has become an important study to develop the collective land property in order to promote the socialist market economy.The collective land property of Nan Hulin has particularity that the village is in the mid-east region,and has decentralized operation and low agricultural benefit,which causes the transfer and separation of collective land property,the diversification of property right objects,and the weakness of collective ownership of land.Village Nan Hulin has positive influence on the property right of peasant collective land.To begin with,peasants own long-term rights to manage their land.Apart from this,peasants have more chances to live a better life.Therefore,Village Nan Hulin increases farmers' income and develop its secondary industry rapidly.However,Village Nan Hulin has some difficulties in property rights,debris fragmentation in the right of land use,land transaction and the land acquisition,which decrease the development of countryside.The reasons about the problems are connected to the law,the government and the village committee.In order to solve the problems about the collective land property,some feasible countermeasures must be taken to have positive and significant influence on the reform of collective land property in China's parts of villages.On one hand,our country must regulate law system on collective land property that public ownership must be still insisted,the separation of three property rights must be implemented,the system for land expropriation and requisition must be completed and the land circulation system must be speeded up.On the other hand,government must regularize its behavior in the work of land expropriation,and transform the government functions,in order to correctly exercise their rights in land management.Besides,the village committee must carry out the relevant policy and standardize the ways of management and ministration of land.
