Research On Legal Issues Of Safety Supervision Of My Country's Oil And Gas Pipelines

Oil and gas pipeline,the pipeline which is used to transport oil and gas,is an important national infrastructure,which plays an important role in guaranteeing and improving people's livelihood and promoting the sustainable and healthy development of the economy and society.In recent years,along with the growth of China's oil and gas consumption and imports,the scale of oil and gas pipeline has continuously expanded,and the construction and operation levels have greatly increased.It is estimated that by 2020,the scale of the national oil and gas pipeline will reach 169,000 kilometers.Along with the transformation of energy structure in China,oil and gas pipeline has entered a rapid growth period and a period of frequent accidents in which there are many large-scale pipeline accident pipeline accidents.By exploring the reasons for this phenomenon,we find that besides the aging of pipelines and the expansion of the scale of development,the legal institutions for the safety supervision of oil and gas pipeline in China is still incomplete,and it is impossible to effectively prevent pipeline safety accidents through legal adjustments and administrative supervision measures.Under the background of the rapid development of oil and gas pipeline construction,the safety of oil and gas pipelines is related to social public safety and national energy security,so the importance of supervision is self-evident.In terms of the structure and content of the article,this article is divided into four parts in addition to the introduction and the conclusion:The first part is the status quo of China's oil and gas pipeline safety supervision legal institutions.Through network information retrieval,2810 normative documents were retrieved for analysis of research samples.Then we sorted out the status quo of the legal system of China's oil and pipeline safety supervision department and the current division of regulatory functions and supervision methods.The second part is the existing problems in China's oil and gas pipeline safety supervision legal institutions.Through combing and analyzing of the first part,we found that there are problems in the legal institutions of safety supervision of oil and gas pipeline in China:in terms of legal system,there are still problems of incomplete legislation,improper legal convergence,and unclear logic between legal provisions;in terms of supervision department and the current division of regulatory functions,there are still problems of diffusion of functions,inconsistent power and responsibility,and functional conflicts;in terms of supervision methods,there are still problems of lack of procedural regulations,low efficiency,lack of a system to guarantee the way of exclude hidden dangers and inadequate accident handling;in terms of responsibility system,there are still problems such as the responsibility of the administrative department is not clear;civil liability is not specific and pipeline corporate responsibility is not fully implemented.The third part is the practice and enlightenment of the safety supervision of oil and gas pipeline in the United States.It studies the relevant systems in developed countries and draws lessons from the practice of the safety supervision of oil and gas pipelines in the United States.The fourth part is the suggestion of perfecting the legal institutions of China's oil and gas pipeline safety supervision.According to the previous issues,we should learn from foreign experience on the basis of our country's actual conditions,and put forward sound suggestions:improve China's oil and gas pipeline safety supervision legal system,clearly define the main functions of the regulatory department,innovative supervision ideas and methods.
