The Exploration Of The Phenomenon Of Administrative False Action Of The Grassroots Government In Our Country

In the process of comprehensively deepening reform and building a country under the rule of law,truth-seeking and pragmatic is undoubtedly the primary task of government style construction.At the same time,grassroots governments have always been at the forefront of administrative work,the implementation of national laws,regulations and policies,and the handling and resolution of social conflicts and disputes,playing a pivotal role in connecting the central government with the masses.After the sixth plenary session of the 18th central committee of the communist party of China(CPC),in response to the problem of "being lazy and doing nothing"proposed by general secretary xi jinping,all parts of the country began to do not take on or do not do special governance.Administrative personnel are either engaged in whitewashing their political achievements,or they are divorced from reality and make decisions at will,or they just say no and react passively.However,it is difficult to find out the characteristics of whitewashing and concealment,thus forming a bad atmosphere of new formalism.It is urgent to take strong measures to eliminate it.As an act of deceiving the top and concealing the bottom,"administrative leave" has aroused great concern from the party and government organs and all sectors of society,which seriously undermines the party and government spirit and will further erode the reform,development and party and government construction in the long run.Since the eighteenth congress,xi jinping pointed out that the construction of the government shoulders the rule of law of China's most important responsibility,and a series of new ideas,new judgment and new requirements,therefore,from the perspective of administrative responsibility to analyze the administrative false as,is not only ensure the needs of the decision to carry out the strength,is also necessary to improve the responsibility of civil servants.This paper tries to take the administrative responsibility as the perspective,starting from the concept and classification of "administrative act",through the conceptual analysis of administrative act and administrative omission,to make a comprehensive preparation for the concept of "administrative false act".Secondly,through a large number of data and case study,summarize the performance of administrative leave and make a systematic summary of the characteristics,and the harm caused by its elaboration,in order to explain the necessity and urgency of governance of administrative leave as.Next,taking the ethical theory of administrative responsibility as the tool,this paper focuses on the analysis of the root and causes of administrative leave from the perspectives of the institutional environment with hard constraints and the ethical norms with soft constraints.From the objective aspect,it analyzes the system deficiencies and summarizes the practical defects from the four aspects of the key links of administration:decision-making,assessment,accountability and supervision.From the subjective aspect,it elaborates from the deficiencies of the institutionalization of administrative morality,ideological and moral education,and individual ethical autonomy,aiming at the target,so as to find the right remedy.Finally,combined with China's national conditions,the two directions of rule of law and rule of virtue are bidirectional and parallel,in a coordinated way,to explore the effective path of administrative leave as governance,to put forward practical and effective measures for future administrative practice and government governance activities,and to provide theoretical research and text records to put an end to the emergence of administrative leave.
